The 3GS would be better as it faster. I don't have an iphone nor an I with AT&T. ther eis no way you can get the iphhone without a contract. It is an expensive phone, and they only offer it with a 2 year contract. I don't like contracts either, but the major providers have them, and there is nothing you can do about it. The only way you're going to get a phone contract-free is if you get pre-paid. However, pre-paid doesn't offer anything beyond basic text messaging. To have 3g technology you have to have a data plan that supports it, because 3g is a type of data connection such as wi-fi. Most carriers don't offer it on anything other then a smart phone, which they don't offer without a contract. You'd have to talk to carriers in your area, but you sound like all you want is pre-paid.
