third party check deposit

my friend put a check written out to me in her saving account as a deposit,after five business days we returned to her bank the bank said the check had been collected and gave her the money in turn she gave me the money the next day her bank overdrafted her account because they said the bank from which the check was drawn from "took back their money" now they claim their going to get me legally and criminally

Look out for those banks... Things real strange can happen in these days. Your just another example for what´s going on. Once i take the summary of my account and the money i had just not was right althoug no movements where registered... After many days running around they call me and said that it has been a computer mistake... Unfortunatly i´m not dumb enough to fall for that cause computers doesn´t make mistakes... Human do!! I have a process in court since then... Unfortunnatly in Portugal things are slow... Ok they like running backwards!

If you sigebned the check over to her then she had a right to deposit the cheque. If she just deposited the check made out to another person then the bank from where the cheque was written is just looking after their client's interests. However some people can have the bank acept third party cheques.
