What would you do if.....your Home Owner's Association had your pool redone and

The construction company didn't cover up some important equipment in the pool room that they accessed, even after being informed of the equipment and they agreed to take care of it. So the result is the equipment being damaged from the excessive dust, plaster particles, fiberglass particles, etc. in the air from their construction. Are they responsible to fix the equipment? What's your opinion. I feel they should be responsible for the damage, especially after taking responsiblity to take care of it and covering it up.

I do think that they are repsonsible for the damaged caused. Better seek legal advice if the damage was excessive and totals to a hefty sum. I don't know what are the laws in your country regarding this matter, but weigh all your options before you sue.
I had a problem with the tiler who have done bad works. After two years i am still in court and though I am certain that I will win in court, I am not certain if I ever get compensated for bad works plus money that I have spent in court. So do weigh all your options before going to court.

good point! I feel it would be reasonable to only pay them the balance of the amount due left after fixing the equipment that was damaged. Let them take the HOA to court for the rest. The equipment was brand new, literally not even a month new...so its not like it was old and ready to be replaced or anything. The HOA is seeking legal advice before anything is paid. That's always a good thing to do.
