Drinking and driving father fatally injures daughter...should he go to jail?

A couple of weeks ago, in Vancouver, Washington a father was pulling his daughter on an inner tube behind his truck, he made a tight turn which caused the girl to hit a brick bench. She died from her injuries. It has been widely reported that the father had been drinking while driving his truck from eyewitnesses. Instead of dialing 911 after the incident, the father drove his injured daughter to a local Vancouver hospital, she was later transferred to a Portland, Oregon hospital where she was pronounced dead. Apparently because of Oregon law deputies who arrived at the hospital were unable to order a blood sample from the father to determine if he was intoxicated. So far, no charges have been filed in the case. You can find this story on the local news website kgw.com under Vancouver local news. What do you think? If it can be proven that the father was intoxicated and negligent what do you think should be his punishmnet? Apparently as a part of his separation agreement from his ex-wife he signed an agreement not to drink in the presence of his daughter!!
