It was brought to my attention by a friend that they had tried to order one of my books through Barnes and Noble, and another friend tried to order it through Amazon! And both were told.....not available. Well I contacted my publisher and they told me that my availablity contract had expired a year ago! Oh...they forgot to tell me! We got the book reinstated to all the outlets but I am still very angry! It makes me wonder how many sales I could have had if someone had been on the ball and contacted me!!! I am so angry! Wouldn't you be angry? Or do you take things like that in stride?

hey jillhill i'm not surprised you are angry thats what they are there for. Try not to dwell on it think positively at least you have corrected the issue now how long might it have been before you'd known otherwise. Do they not keep details of enquiries?
I didn't know you were a writer what books have you written? I am currently writing a lens on another author and have done and interview as an insite perhaps at a later date i could do a similar project with your self.
Good luck with everything there might be a new surge in sales with it now being available you never know!

Hi Jill, I did in fact get an email from Amazon yesterday saying this and was going to email you to say they were unable to supply so how could I get it. I received the first one ok but not the second. I would be very angry over this as like you say you don't know how many sales you have lost because of it. You happened to know about these orders otherwise you really would still have not idea this had happened. I would be asking for some sort of compensation from them for loss of earnings. I am sorry this has happened. Does it mean that now this is resolved I can reorder now then and obtain this time as really looking forward to reading it. Ellie :D

Yes...you should be able to reorder and many thanks to you because if you hadn't ordered it and not recieved it I would still not have known that the contract had not been renewed....in fact I wasn't even aware that I had a channeling contract! So many thanks Ellie!

Hi Jill, Right I will go now to Amazon and re-order a they have credited account saying it was unavailable. I am so glad you managed to sort. I was thinking about it earlier today and what I would suggest you ask them for in way of compensation for not informing you (your publishers that is) is the sales from the previous year plus an additional 20%. Just a thought. I am still looking forward to reading it and you must also let me know when you finish you latest one. Ellie :D

I totally agree with you. Don't blame you a bit for being angry. I wouldn't take a situation such as you mention in stride. I can tell you that I would keep close records of all information available if I had books on the market. I'd make sure I knew when the availability contract expired and keep records of any and all sales, if there is a way for you to track sales. When it comes to money I am right on top of things especially if it's any kind of earnings.
Much success and have a great weekend,
carolbee

I'd be very angry and I think you might want to change publishers. Or at least seek out legal help since this was lost earnings because they didn't notify you of the expiration. I'm surprised they didn't notify you since your lost earnings is lost earnings for them, too. I'm not sure if there is anything you can do but make sure you check out this for future expirations so you don't have the same thing happen again.
I'm sorry this happened to you, though. I'm in the process of starting my own publishing company and I will keep this incident in mind so that my clients don't go through this.

I meant to tell you that the other day. I did find a site where I could get it. Then had them used for $1.99 and a brand new one was listed at over $200.
You have every right to be angry. Who knows how much money you could have been making.

Sorry, I had to get up and one of the kids hit the submit button I guess!
Ok, Had it been an oversight of a few days or a week, it would be a bit more understandable, but a full year! That is really bad business. It's too bad they can't compensate you somehow for those lost sales.
I didn't realize you had a book! That must be exciting!

Wow, I would be extremely upset too! I don't understand why they would not have notified you before this happened?
So, what is the name of the book? Are you an author? That is really cool if you are! What is the subject of the book? Also, do you sign copies and mail them out on request? Enquiring minds want to know.
Have a great day and happy myLotting!!!

Uh, I would be angry. I don't even know what an availability contract is. But you'd think they would describe it to the authors in advance and let them know the terms and conditions of it. That is so frustrating. I asked my husband if he'd ever heard of this type of contract (he's well-published) and he said, "no." He writes nonfiction, so there may be a difference between fiction and nonfiction, in terms of how those contracts are handled.
Good luck and hope you get that taken care of right away.

I had an availability contract with my first publisher, which I signed with them. The expiration date was clearly stated in several places on the contract and I was provided with a copy of this. One of the clauses of the contract was that renewal of such had to be instigated by myself, and that this would not be done by the publisher.
So, whilst I can see that you'd be upset they did not contact you, there may have been forwarning of this in the paperwork that you completed with them.
