should the driver be liable

This is a hypothetical legal question. Would be interested to know your opinion. There is a man driving on a regular speed hit someone in the road. As it turned out the guy is committing suicide so he jumped blindly into the road and got hit. Of course no one know of his intentions because he died. Will the man be punished? How would you defend him if you are his lawyer?

usually,it is the driver ,who is liable(according to traffic rules)whether the driver is right or wrong.that is why it is said driving a vehicle is very dangerous,whether the driver has committed a crime or not.(he is punished)
