Bank of America bought out our mortage compnay and scewed us!!!!

ok back in like I think it was July BoA bought out countrywide and we had made a July payment in like the 3rd of July Then we sent in August payment the last of July and they tried to tell me we hadnt made Aug. payment I made them look it up so we owed 9 cents so I had to write a 9 cent check. Well the next month we sent our 2 checks in on time and they put it in Mis. And that we were late. Which we were not the next month they tried to charge late payment so we dicided to try for a modifacation and paid lawyers $3,000 to help with it. and by word of mouth got it down to where we could handle it and pay other bills now BoA is saying they didnt sayt that and want $200 more a month for the next 2 months and us make up the $200 that wasnt on this last payment. Takes me for ever to talk to the lawyer people then they dont get anywhere they leave it up to me to call and try to stettle it and the bank says nope stand at the big amount even though our wages have change extremely! I am so upset abou this I dont know what to do I dont want to loose the house I had my last years with hubby. and we put our savings into it. And I know the houses around us have lost how much they were worth 2 years ago and can buy one with payments around $500 a month! Do you think the back should lower our payment and the cost of the house down to what others are goin gfor now?

Joan, i'm so sorry u are having this kind of trouble. I hope u can get it all worked out. Sounds like a rip-off to me but they know they have u over a barrel & i hate it when someone does that. Them having u write 9 cent check was ridiculous also. Sounds like to me they are being a bunch of A$$ES. hOPE U GET THINGS WORKED OUT TO YOUR BENEFIT.

Yes I do so Not just that why is the Lawyer not sorting this out as you have paid so much to them and they are the ones that got the Payment down for you so why are they not onto them???? Also time for some others to throw in as well and start paying you know what I mean But the Lawyer should be onto them as they dealt with this and they got paid for it so get them to sort this mess out Hugs

I would contact another lawyer. It is their fault. They should make it right. I would not pay those lawyers anything else. It was their job to fix. I doubt you are going to get them to lower the total amount you owe, but I would bet they should work with you to get your payment lower. I have the same company, I am so glad we did not run into that problem.

I have been with 4 different Mortgage Companies in the past 11 years. I was also with Countrywide for only 3 months when the sold out to BAC I have been with BAC for about 18 months and just last night I signed the papers to refinance my mortgage with BAC. So far I have had pretty good service with BAC but I did have a problem with the transition between Countrywide and BAC. Countrywide said they had paid my Homeowners Insurance and kept my escrow but BAC said they did not paid it so they paid it again which left me $500.00 short. So that implied that my Homeowners Ins had been paid twice to Allstate.....what a bloody mess but I did get it straightened out. I have learned to scrutinise every movement online with Mortgages and my banking business.

I am glad someone is sort of satisfied with them but this isnt a redo on a mortgage its a modifaction sort of differnt that what you went thru and yup I had the same thing when we moved to this house about the insurance took me ages to straighten it out for on ecompany was trying to charge $698 when the Company we had pick only charged around $400 that was 8 years ago!.

i have heard some bad,bad stuff about BoA.all their services. you might want to call wachovia/wells fargo and see if they'll assume your loan and give you a new mortgage.we've never had a problem with them and they've always been very friendly if you had a question. there might be a fee for assuming the loan,but if you can i'd run as far and fast away from the other company.

awwww thanks for your advice. but I dont think another company would take the loan for it is upside down now with the drop in prices on property around here, And I like Wells Fargo as they are the bank I do my banking with.

true,but they might surprise you-it's worth a go. they've reassigned a lot of properties in my area,in some cases reducing rates for people, just extending the arm of payment so they can catch up which i think is nice of a bank nowadays.

I haven't a clue but whoever this so called lawyer is you have should be brought up on charges himself! $3,000 for what! Doesn't sound like they did very much. I wonder if there isn't a lawyer in your area that might have more experience in this field. I would tell them what has happened and find one that will help you get your payments back to normal and even some back or no payment next time because of the extra you have payed out recently. I see no reason why you should have to pay more just because of a bank change. I would see about refinancing and going through another bank. Is there any justice in this world??!! Good luck!

thanks for responce. The lawyers I have are in your state adn I have been assigned a worker for my case but since they sort of tok down their hours she is swampped! I do think now she will work better for me as she says she has a vandata to get the payment where she was told it would be BoA dropped the ball by not locking that pay in.

Wow LKo I'm sorry to hear this. Ain't the government doing something about loan modifications? BTW you should consider getting your lawyer for attorney malpractice-your family is in my prayers ((hugs))

yup that why I am doing it but looks like the bank dont know what is to be done to many people not knowing the rules or the way to go about revising things. She working on it now we had a 3 way on the phone seems like the bank wanted to hear from me with her on the line too. for me just calling I got no wehre . and with her just calling she got no where but together I think we can get this done!

The thing is that the Bank of America is hurting you more than just financially, they are stealing your home and your reputation as a paying customer. This will go on your credit report and if you even wanted to buy one of those houses that have gone down in value you won't be able to... With a bad credit history it will be hard for you to find a place to rent... Your only option is to pay up if they don't work with you and for you. I can not give you hope in the kindness of humanity... I can not give you anything but an honest reply to the situation you are in... I can wish you luck... thanks so much for your responces! And for sure between me and the lawyer lady we will get this going in opur favor. And I wont give up hpe of this even if I was very down about it. all that day untill we had that 3 way call. The one thing I havenot signed on any paper work they sent me so it all shouldnt be set in stone. love and hutgssssssssss

I just read all the responses and I hope things work out as there is hope that Monday things will be made right... My fingers are crossed and best wishes sent your way... The low payments are a result of a low interest rate and they are locking you into a low interest rate and on Monday what will that interest rate be? It is amazing how a few tenths of a percent can change the amount you pay for in the long term and monthly on your mortgage. Your life is not a game... But to many people life is a game... They can be ignorant and mean, The victims are a source of amusement... The real christians are once again thrown to the lions, it happens over and over again, we keep repeating the same horrors just in a new theater, they find new and creative ways to punish us fellow human beings. I wish I could be of more help...

Tonight on the news a judge gave some people their house free and clear because of all the trouble they were having with the mortgage company....the people had tried to negotiate with them and they wouldn't even try to help the couple save their home....my friend somehow also got into a loan with Bank of America....she is having nothing but trouble!!!!! Hopefully you can get it straightened out! She is trying her best too and it's a mess!

lakota I dont really know a lot about this part of housing business but why not refinance with a reputable place and cut your mortgage payments down to where you can really handle it. we had to do that once on a house we and the bank owned.

we had already refinanced about 3 years ago and when ya do that you have to comejup with money to pay that little odd bill that might have got shoved aside when the payment were so bigggggggggggggggggg

Go to loansafe dot org - you will find lots of helpful information on BoA modifications and who to contact and how to escalate issues. It is a lifesaver. It is all free information available to the public and they talk about all the major banks.
