Delinquent Employers

its been a year now when i resigned from my previous job. one year have passed, still i am going back to them. i tend to go back not for the company per se, but to have my right of getting back what is mine. for two years of working with them, they are obliged to pay my social security system (SSS) contribution. as a good employer, you must know the right of your employees and one of this is the benefit of your employee to be secured in any matter he/she will be facing. wether a calamity loan or housing loan. unfortunately, i have worked to a company, infairness to them, they feed my stomach for how many years but taking what is your employer's right still out of the law and they did not pay my 2009 contributions, but they already done, less to my monthly salary. my former co workers and i discussed what would be the proper way to opened it up to the company. and let them know what we are feeling about their mismanagement. unfortunately, the words they said was, they do not have money to pay our contributions. have you been experience this kind of delinquent employers?

I can feel for you. My first two employers have been like that as well. But the second one is the worst. Among the more or less 20 employees who have resigned because of being biased and delinquent, I am one of those of have been harrassed, black mailed and left without a back pay. It's a very long and emotional story when I look back. But bottomline, being honest, prudent and skillful has then led me to multinational companies like Reuters who pays ten folds better and rewards more as a token of appreciation to your hard earned efforts in working with them. Right now, I work for a multinational health care company and looking forward for greater challenges and rewards.

Yes, I have met several delinquent employers. The best way to handle these kinds of employees is to report them to DOLE and SSS where a criminal case will be filed against them. No amount of pleading from you and your co-worker will make them pay. You are just wasting transportation money - let the authorities handle it and move on with your employment.

in australia here, we have an organisation that is called the union that can protect the employees from delinquent employers... so if we have any issue with our employers, we just have to report it to the union and they can help us to resolve it... i don't know about your country though... there should be an organisation that can protect the employee's rights from the delinquent employers... take care and have a nice day...

I'm fortunate that the company I worked for provides all the benefits that's within the law. In fact it even provides mid year and Christmas bonuses on top of the government required 13th month pay. In your case, it's only right that you thank them for feeding you the entire time you worked for them but you also have to realize that you worked for them and those hours you spent working contributed to the companies output. Which means that if you owe them some debt of gratitude, they owe you too and the least they could do is give what the law requires them to give you no more no less. I don't believe that the company don't have the money to pay your contributions, because if the don't then the company should have been bankrupt already.They are just telling you things to make it appear that way so that you won't raise a complaint.

Yes I did experienced that when I was still working as a contractual employee. The agency that I was working with that was connected to the company itself does not remit the SSS contributions that they were deducting from us. Little did I know that all the months I have worked there had no contributions at all to my SSS. I have no way of complaining to them because they have let me sign an agreement or waiver that I will not be asking anything from them anymore before I get my final pay or back pay including the yearly bonus and the tax refund. Well, it is just charge to experience.

Yes, that's why before we sign the quitclaim form, everything must be checked. There are a lot of deliquent employers huh! Have a good day!

If i get it right, you said that your salary is lessened for that contribution, right? If so, the employer has no reason at all to say that they don't have money to contribute for that. Check your salaries for 2009. If they deducted your salary for the contributions, you have the right to report them to SSS office. And they will be declared deliquent employers and they should pay for your contributions. It is employer's obligation to pay for that. They will be penalized. You should also check other membership like Philhealth, PAG IBIG and BIR. Those are important and it is your privelege as an employee to have contributions for that.

We both share the same sentiments regarding our employers. My current employer have not payed my SSS and Pag-ibig contribution for 2 years. They have not given me my separation pay. When i tried to follow-up about this to my boss, the answer i got is "the company has no funds yet." This is really frustrating.

That is difficult my dear. One company should pay their employees SSS contribution and what is that lame excuse that they don't have the money? when in fact you are being deducted on your salary monthly on your SSS. Consider thinking it well if you file this report to DOLE because every citizen has the right to get covered with their SSS. Your company is cheating and it is a clear ground to sue them so that all their employees would benefit the SSS contribution. Opening it up in the company is really hard, they might even get hard on you. It is your choice now if you would voice it up. See if you can talk this to the HR and ask their side, but you should know that it is advice to report a firm or organization that collects SSS and yet don't remit.
