Step Parent Adoption....how do I do it?

My husband wants to adopt my 6 year old daughter. Her father was incarcerated for most of my pregnancy, and for her first 5 years. He got out June of last year, and has seen my daughter twice. Maybe three times. He and I were never married, and he is not on her birth certificate, but he had DNA done which proved his paternity. He has a history of violence, and assault on me while pregnant with my daughter. My husband is a good man. He works, doesn't abuse me or my children, and takes great care of our family. What do I need to do to get this going? How do I go about starting the adoption process? Im in Illinois.

Does the biological father agree to that? Why did he have the DNA test done? The best thing is to ask a lawyer to help you out because every case is different. There are lawyers who specialise on adoption and not all are expensive.

Look for a lawyer that specializes in adoption. Has the court awarded him any rights? Why did he have the DNA testing done? Has the court ordered him to pay any support. He might be willing to voluntarily have his rights severed so that the adoption can proceed.
