So My House was Listed for Auction

I received a notice today from the company that I had borrowed from to purchase my house that my house was up to be publicly auctioned. My house was finished being paid for in July this year. My son and daughter (at different times) were told that I would be required to sign the final papers for closure on my return to the Island. The company had the contacts and email addies for both son and daughter and yet they put up my sale to be sold at public auction? I went to their offices this morning and asked them why they did this. They said that the closing costs had not been paid. This is equivalent to just over US$500 and yet they did not bother to contact my children but just put it up for auction? Why would I have paid extra mortgage for seven years in order to have my home oaid for in fll before I retired in order to lose it for not paying the closing costs? I lost it - albeit quietly - and was at my best as I verbally demolished them. I wish that I had had a taser and then I woud have zapped them The end result was that I received the necessary receipts for the closing fee and will be receiving my title in due course. But the stress was just horrible and I was so mad that I cried in the office and it was a horrible experience. Has anything like this ever happened to you? I'm not smiling

It would have killed them to make an effort to contact somebody? Nope, nothing like this has ever happened to me. I do recall a situation when I worked at a mortgage company where we didn't pay somebody's taxes, and it was in a state where they auction properties for non-payment almost right away. I don't recall what the outcome was though. Deep breaths... You are not having a good year (says Captain Obvious).

What a horrible thing to happen. How distressing it must have been. That's big business - screw the little guy every chance they get. I'm glad you handled it the way you did. But their business practices are really suspect. To think they could cheat you out of your house like that. You have survived another major bump in the road of life. You haven't had a good year at all. And on checking your profile I see I've missed notifications on some of your other discussions. You're having a bad time of it. I wish I could do something for you. It seems the older we get the harder life is. But you do a good job of maintaining. And that's what's important. Good that you won out over this sleazy deal, bad that it was a horrible experience. Hope you're feeling better by now.

Thank you - I am okay but it was distressing. When they checked my payment record, not only had I tried to double up on payments most months but I had always paid by the third of the month religiously. They knew that I was off the Island and that my son was handling mortgage payments. They had his details and could have contacted him. It was disgusting what they tried to do. Wow. That is horrible. All the stress of that and having your grandkids come stay with you while you recover from surgery...I wish you had someone to take care of you.

Sorry to be so long in answering. My house is okay as my son paid the closing costs. They were just trying a thing with me and this I resent.

with my luck they would have auctioned it before i found out. you must have a guardian angel anyway, it doesnt surprise me . sounds like they were trying to pull a fast one. ive lost 2 houses from health issues. cant go into it all here but at least im safe for a while. glad you saved it.

Really no one knows God policy is once start problem then come one by one by heartly wish next year will be better. But this is wrong if auction company is not informing to your child. You can complaint against them because without contacting they cant do anything. Every member should be present there.

It was withdrawn from auction and all is well now thank God. I did complain and they just said that a mistake had been made

I'm glad that you have resolved this situation, but it shows an enormous oversight on their part. You should try to submit a formal complaint or something. They shouldn't be allowed to get away with this type of behavior.

I lookedat a listing of their Directors and personally know too of them. So I plan to cc an email to the CEO and copy to the Board - specifically the people that I know. I think that they were disgusting in their bahaviour.

The jerks!!! They could have contacted someone about those closing costs. They are trying to make a double profit and sell your paid for house. I would think that they would be required to notify you before an auction could take place, and perhaps that is what this letter was about, but this is unscrupulous. You do not need the stress. Is there some agency that they can be reported to? This is not good for your health. You have enough going on.

Yes, the letter was the fianl notice to inform me that as the closing costs had not been paid the house nwas placed up for auction and thiswould have appeared in the newspapers tomorrow,It was the most awful feeling - hard to describe. My children would have found themoney to pay for this. They found the money to finish paying the mortgage whilst |I was in the U.K.! My son would have put it on his credit card if he did not have the cash. My record of payment was impeccable as I tried to double up payments most months to pay it off before I retired. I never paid late at all. It was a huge shock to me. what nect is going to happen to me? sorry to sound so pitiful but this year has really got to me.

Wow! That is the last thing you need added on top of all the other things you are dealing with lately. I am glad you were able to get this issue resolved, but I would still be upset about it.

I would of been so scared and angry Cynthie! I'm glad after you gave them a piece of your mind that they get their papers in order. Sounds like someone messed up big time and no one double checked their p's & q's before they went ahead with something so extreme. I would do a happy dance when you get those final papers and keep on them til you do!

Well I'm glad you got it straightened out in the end, but I'm sure it caused a lot of stress in the meantime!! How awful of them not to make every effort to contact you before putting the house up for auction! But again, I'm so glad it's taken care of and you won't be losing your house! Is this the same house your children grew up in, or have you moved into a smaller home since then?

BLESS YOUR HEART, it's about time u got a break from all this hell u have been going through.You are way past due for some good luck to come your way. I know u were upset, i would have been to. I would have probably gone to jail after i got through giving them a big piece of my mind. I'm glad u have it all worked out but i know the stress of it was hard on you & u sure didn't need anymore stress!!!!!!! I have never had something like that to happen , THANK GOD. TAKE CARE.

Goodness that must have been a horrible ordeal. I am glad you got it all situatied and that you did not lose your home. Sounds as if they just wanted to auction your home off and see how much money they could make from it. Glad it all worked out.

You were right to flip out on them and tell them what you thought. Taser? I would have wanted a much heavier piece of artillery. I've been through bureaucratic bs before but I can't say I've been through something quite like that. Glad it ended up working out but there really was need to put you through that kind of stress.

My recors would show that I paid more than was what required so as to fi ish payhing for it before retirement so why would I not want to pay the closing fee? Having still not recovered from a triple by pass I just don't need this kind of stress

That is too awful. Either pay and bear or pay and protest... whatever you do, first pay it up so that no further charges will be levied upon. Private finance companies are like bed bugs... they dwell in your own resources and bite you only..

You are so right. I paid in full yesterday but am lodging a huge protest with the Management Board on the actions that were taken. This is a small Island and they will not like bad publicity. It was an awful shock but I am wondering what today will bring

you did really well, you won. it sounds incredibly stressful, but it got sorted out. i'm shocked that they can so easily sell your house, just because you hadn't paid the closing fee. aren't there any other legal processes they have to go through before being able to sell it? here in the uk a mortgage company would have to go to court and repossess it, can they just auction it, even though you had paid the whole mortgage?
