Who Is Liable For That Road Accident?

It was a fateful Sunday, February 28, when a 10-year-old girl got bumped by a passenger jeepney after she crossed a busy highway. She suffered a broken clavicle bone, and a blood clot at the brain.
Her mother was at the other side of the road, and she made a hand signal for her daughter to wait till she gets to the girl's side to fetch her. But the girl thought her mother was telling her to cross.
An approaching passenger jeepney bumped her, causing her to fall down. Good thing she was not directly hit. The neuro doctor said it was a "miracle" because the child did not suffered much thinking that there was a blood clot in her brain, as seen from the CT scan.
Who is to blame? Was it the driver's recklessness or the mother was at fault?

It was a very sad day for the mother; she was so afraid she might be blamed by her husband.

Good that she did not suffer internal hemorrhage, if the driver was over speeding then it is also is fault. If not and that the girl just came and it was already late for him to stop then not actually his fault. Now, i wonder why this mother just left her daughter on the other side. She should be blamed here for being negligent.
