My DIL or granddaughter could have been killed

On Friday, just before I got really sick, I got a call from my DIL to come get my granddaughter and their little dog. They had been going to the park for a picnic but got into a crash. A lady apparently ran a red arrow on a left turn and crashed into the side of their car, hitting the driver's side fender. A fraction of a second later and she would have hit my DIL's door or the back door my granddaughter's car seat was positioned at. The driver was on her damned phone at the time and not paying attention to what color the light was. Since there were not witnesses the police didn't give out tickets so it will be hashed out in court. My granddaughter is okay, bruises on her shoulders from the straps of her car seat and it scared her. Before this she would occasionally try to take her straps off but I doubt she'll do it again. She got to meet firemen and police officers and is no longer afraid of them (why was she in the first place?!). My DIL will never put the car seat beside the back door again just because it's easier to get the child in and out. Middle seat position, every time. Unfortunately, it's only on TV that the police can call up a cell phone's "LUDs" in just a few moments and without a warrant and say for certain that someone was making a call or texting at a certain time. It will be hard to prove the woman was talking on her phone. At least my DIL will look to see if anyone is moving who shouldn't be the next time she starts forward on a green light. I am so angry at that woman!! She could have killed my DIL, my granddaughter, or both just because she couldn't put down her damned phone and pay attention to her driving. Her life is too damned important to pay attention to the safety of others. I'd really love to give her a piece of my mind!! Have you ever been in a crash caused by a driver on their phone? Did they suffer any consequences? Do you use your phone when you drive?

Phone records can be had but not the convo, unless its a serious case like murder.

I think it should be mandatory that cell records be kept and made available. So many people are killed and injured every day because of irresponsible people who think their lives are so important that they can't be distracted from their phone by watching the road. I think penalties should be more severe for those people.

@dragon54u - depends where you live and if its a big problem in your area. California has laws on texting while driving.

Sorry to hear about the accident glad they are both ok. Never been in an accident caused by someone being on their phone.

I never have, either, but I've been in some near misses and the drivers never knew they almost hit me. It's like they are oblivious to everything around them except the phone!

My goodness Dragon, it was a miracle they survived this. I am wondering why they will not just take her word for it about the woman on the phone. I mean surely..but makes me so mad!!! I hope you get to feeling better too. I am so glad they are okay.

They are fine, thank God, it's a miracle no one was hurt badly except for bruises and the DIL has a black eye from the air bag. Looking at the cars when I drove to the scene I could tell immediately that the other car turned into my DIL. I'm sure the police will illustrate it on their report well enough that it's clear what happened. I'm feeling better, thanks, hope to be feeling normal by tomorrow!

@dragon54u Yes it will be their diagram of the accident that will tell on her for sure. Good you are feeling better and I am so thankful they were okay in general..sheese what a fright though.

Oh @dragon54u , how lucky they were. Texting & driving by 'others' makes me insane. I've never been hit by one but that's because when I'm driving, my head is rotating like the Exorcist. I take my phone only for emergencies.

@nanette64, me, too!! My head is never still, looking ahead to see if the driver is looking right or left and might turn, looking behind to see if they are paying attention, I look before starting at a green light, I never run a yellow unless it changes when i'm at the crosswalk. There is so much to look for, pedestrians crossing when you're turning, dogs and kids, other cars that are all over the road...it's a full time occupation!!

I've never been in that position, and I am so grateful that they are okay! Things could have been so much worse. I still see people driving while on their phones, even though it's against the law here, and I don't understand why anyone would take that chance.

They take the chance because they have as highly elevated sense of self-importance and they don't give a damn about anyone else's safety. I think anyone caught on a phone while driving should get an automatic 7 days in jail and be prohibited from owning a cell phone for at least a year.

Car seat seat belts arent supposed to be lose enough for kids to be able to get out of them. So make sure they tighten those even iglf you dont think your Granddaughter will try it anymore. Also, they always say the safest place for kids is the middle in the back. Although everyone seems to take "the easy way" and put them on the doors. Glad they are okay and hope they can win in court

My granddaughter is 3.5 years old and very good at getting loose from the straps even if they are tight. I doubt she will again, though. We explained to her that she was alright because of her car seat. The firemen made sure to tell her they were so glad she was in a car seat and she asked if she would be in heaven with our dog if she wasn't. They told her probably so! The cops also reinforced how lucky she was that her mommy loved her enough to put her in a good car seat. We all know that car seats are supposed to be in the middle and too many of us take the easy way. I'm just so grateful that her cutting corners did not cost the ultimate price of her precious daughter, it would have destroyed her. The seat is now in the middle of the rental car!!

people should take care while driving and should not talk on phone. yes few months back , a car hit my leg while going on a bike , i got small scratches , the man who is driving the car just controlled on time otherwise my leg would have got fractured, he agreed that it was his mistake, but what can be done , my leg got swollen and i was not able to walk for 2 weeks.

How painful for you! Cars should be more careful of bikes. We have bike lanes here so bikes will be safe but being Americans, our bikers take advantage of the lanes and ride beside each other rather than single file, taking up part of the car lane. Our joggers also use the bike lanes which cause the bikes to veer out into the car lane to avoid them. I hope you're completely recovered. I'm so glad you did not get a bad fracture!

We rarely use our mobile anyway but we do see people on their phones while driving. It really is criminal behaviour.

I don't understand why it is not punishable like a criminal act. It is willfully putting others in danger. The penalties in the states that prohibit it are very mild, yet this one act kills and maims so many.
