My water heater is smoking

For over a month black smoke has been coming out of the chimney every time I used the hot water. I thought it was normal until my father noticed it and said my water heater probably needs cleaning.
My father in law came a few weeks back and adjusted the flame and changed the nozzle I think.
Yesterday it was smelling like smoke in the cellar everytime we used the hot water. My father in law came and took a look at the water heater and said he would come back the next day after he gets a new part it needs.
Hopefully he can get the part and fix it soon so I can do laundry and not have to rush through my shower.

It still smells slightly smoky but not bad. I'm sick of calling my father in law about it so I sent a picture to my brother in law asking if two hours in the top of the water heater should be there or covered by piping but he hasn't responded yet.

@Shellyann36 haven't heard a word back from my brother in law. My father is in town so I had him look at it and he agreed the holes are letting exhaust in and a bigger pipe needs to be on top to cover the holes. Crazy that my father in law who works on these all the time as a plumber has never bothered to do this simple fix.

Unfortunately I am still waiting on him to come back and fix it. I am trying to not get mad about it by telling myself maybe he had a hard time finding the part he needs to fix it. Plus he doesnt charge me for the labor only the parts.

That is definitely not normal, I hope it gets fixed. That reminds me of our air condition since it's not been cleaned for a while.
