Annulment vs. Divorce

Yesterday i read a post from @yoalldudes about divorce.And right in Philippines we don't have divorce but annulment is there. So it made me to think what is the difference between the two and i found out that; Annulment is to declare marriage void which was never valid. And divorce is to end a valid marriage. After annulment, the status of the party becomes single or unmarried and....after divorce,the parties become divorce. Hmmnow i know. Just sharing.lol But no plans for both. Image:google

Annulment would be cheaper than a divorce.

@jstory07 NO. unless there is a serious reason (i.e. bigamy, the husband is impotent and the spouse did ot know), it is cheaper and easier to pursue a divorce rather than an annulment. To get a marriage annulled, the marriage must be voidable.

If there are children, and a marriage is annulled, they become illegitimate.

Annulment makes the marriage null and void which means there has never been a valid marriage ever. Which means it's as if you have never been married at all. Unlike divorce that they acknowledged the existence of a marriage but it's not working between the couple anymore so they just have to end it. With annulment, there are only special elements for it to be granted. Devoid of those elements, the court cannot grant such annulment. Unlike divorce, which only needs mutual understanding between couples. I studied this. back when I was a student.

Annulment if very long to obtain and there must be a valid reason or a couple will never get an annulment in my country. To divorce you have to go to court, if both wife and husband agree is quick and easy and not expensive.

I am surprised to know that Phillipines don't have divorce. Here, we have annulment only for cases where the relationship didn't meet the valid legal criteria of a marriage, means the marriage could not get a valid recognition socially and legally.

Annulment here in india? Hmm my husband never share about me these things. I taught divorce only.

@rhuenz Annulment is in cases where the marriage has no legal and social recognition. Else divorce is the prevalent one.

I had a great aunt who was abandoned by her husband shortly after they married. I think she had the whole thing annulled.
