What can x employees say about you

My company recently let me go due to job performance,I cannot get a job due to them giving me a bad referral. I was with the company for 6 years and was not the only one discharged for job performance. Our company was bought out 3 years ago and was told nothing was going to happen. Come January of this year they had told us they were getting rid of the warehouse which my husband worked in and making some changes within the company. Approximatly 1 month ago they let 10 of us go mostly people that have been there for more then 5 years some even 20 years and said it was due to job performance and that we should go to unemployment. Now were finding out that when we apply for other places were getting a bad rap. How do I approach this situation when I apply for a job?

You can go to your old company because, as far as I know, they are not allowed to give you a bad reference. So you could find out why they are doing that. And you are also within your rights to ask new companies for an explanation as to why you weren't given the jobs.

Well it is a usual criterea of companies to kick out the oldest employees so they can engulf the new talent this doesnt mean that you were negative or had a bad referral Its just that most of them apply this tactics!

I would just explain the situation during interview, also don't use your supervisor/employees who still work there as your references, find someone who will give you a good reference. I think your previous employer can only confirm dates employed and in some cases your pay but nothing else.

It is illegal for an employer to "bad mouth" an ex-employee. Most companies refrain from giving out information and only give necessary information such as start/stop date, if the job was done to their best ability and it they would rehire if possible. I work HR and see this everyday, it is hard to get an employer to give out more information due to liability on their part.
