I am unable to view the story as the link you have provided doesn't seem to work. I would have loved to see it as I am a photographer and am always dealing with issues like this.
As I understand it, if the woman was in a public place and is not the focus of the picture, she would not be able to sue. But, if she was clearly the subject and easily identified, then she may have a case. If the picture is defamatory or an invasion of her privacy, she may have an even bigger case.
Again, I wish I could see the article, I may try to find it through other means.

She is alleging a right to privacy and publicity. I think she might have a case if she can prove that she never authorized this picture to be used by anyone. Apparently, she used to model, so I'm not sure.

I'm unable to open the link that you provided. People sue over riduculous excuses. One time a woman sued McDonald's because she got burnt in the legs. What she did was she went through the drive through and ordered coffee and/or other foods, she put the hot cup of coffee between her legs while she drove. Serves her right anyway that she got burnt because didn't use her head. I'm not sure if whether or not she won the case because it was a long time ago. I hope she didn't.
The United States is the only country in the world with the most law suits.
