Military family injustice

Hi All, I wanted to know how others feel about a particular incident that I as a military spouce have gone through. To give you some background last Nov. I had to have emergency back surgery due to loosing the funtion and strenghth in my left leg. Thankfully that Army send my husband, who at that time was deployed to Iraq,home to the week I was in the hospital and the week after to care for our minor daughter. As it turned out I am not able to return to work because the things I am trained in,Nursing and Child Care, that my retrictions will no longer allow me to fulfull my duties. I had to go part time 6 months before my surgery. In any case I applied for disability via internet like I was told to by social security. My third call to check on this and I was told quote"We dont have to deal with military overseas,you need to go to your Embassy." This is like a slap in the face. I am a United States Citizen and have all rights there of. We have been stationed in Germany for four and half years and are due to return this Oct. I will reapply then however, I do worry about other military families that run into this type of roadblock. I know myself I have no been able to work full time for over a year and it will be a year since i have worked at all this Nov. Let me know what you think. Thanks. I've never dealth with social security directly but I do have several family members who have and I want you to know that being approved for disability is a long, frustrating process. They deny so many applicants, causing so many unnecessary delays, that there are many attorneys who deal only with social security disability claims so you may have to end up talking to an attorney, too. You won't have to pay him/her anything upfront but you will have to pay a percentage of your initial award. By the way, if you applied via the internet you should already have an active claim and shouldn't need to reapply...you will lose those months of benefits if you do...but definitely go to the nearest S.S. office when you return to the states. Then talk to an attorney. I have no idea why Social Security treats people with disabilities so badly but they do. Good luck.

Thank You so much for your advice. I just may need to do that. I dont think I must have been clear enough. It isnt that i got denied they didnt process it at all because they dont have to deal with overseas military personell. I guess that is what upset me most. Again thanks so much for your input.

That is horrible! Here your husband is serving his country, and, even if they couldn't help you, at least they could've been nicer about it! I am so sorry! I am a military spouse as well, and I know if that had happened to me, I would've felt extremely hurt. That's awful. :(

The application process for social security disability is long and drawn out, in the best of circumstances. The fact that you are living overseas at present, regardless of whether it's due to military orders or not, may affect the laws dealing with social security. I don't think it was wrong at all for them to refer you to the Embassy if that is who can help you with the laws governing your particular situation. The Embassy may not be the correct place, but I would suggest you consult a Judge Advocate through your husband's unit. They should know what route you should take.

I am on disability,although not in military...first of all you now need a lawyer, the most they can take is 3500.00, no matter what you get. You will get you money all the way back to the first time you applied for SSD. There are many good lawers out there . SSD usually will deny you the first, it's a given.They are hoping you just give up.DONT GIVE UP. contact a lawyer. He will help you and take all the stress that SSD would give and handle it all for you. That's what I did and I won my case and recieved a 16000.00 backpay check and medicare.Good luck and God Bless.
