How does it work....Can someone help me understand?

I was coming home the other day and a kid in a camaro slammed into the side of my car. He has insurance. But he did 7,000.00 worth of damage to my car. Everyone says that the insurance company might total my car, and I will not get cr#p for my car. Can someone tell me how this works.. I have never had a accedent and have never had to make a claim on insurance. How do I keep from getting scr@#$. To give you a better picture of what happened... I was driving home and as I went around the corner, this kid come flying around the corner coming straight at me. I turned my car as far as I could to keep from having a head on. And he was in my lane and slamed right into the side of me. He was speeding (estimated close to 90 mph) I tore the whole side of my car up, the body shop said that he will have to cut out that side and stub in a new brace and replace the doors, electrical works, and finder and repaint. I have a 2004 blazer that I bought right off the lot and only had 1,800.00 left to have it paid off. Now I have junk, thanks to this kid that had to endanger me, him and the baby he had in his back seat. But what I want to know. Is if they total my car, what kind of figures am I looking at, that they will try to settle for and can I refuse and fight for what I feel is right and far? or do I have to take what they offer?

The thing to do is get a police report and a good insurance adjuster. Cheers!

I have the police report, the kid was given a ticket for speeding, wrekless indangerment, child indangerment and driving without proof of insurance. We did find out he did have insurance. I just hope the send out a good insurance adjuster. Thanks for the response.

I've never driven before so I don't know how it all works, so, I'm sorry that I can't help you there. I'm just glad you're alright. It must have been a very traumatic experience for you. You were very smart in turning your car like you did to avoid a head on collision. I'm very sorry to hear that you are the one to lose in this particular situation. It just seems so unfair.
