I was watching the news this morning, and they had this story, so I found it on the web to share with y'all. Seems that Janine Sugawara of California has filed a lawsuit against Pepsi, or more specifically Capn' Crunch with Crunchberries because after 4 years of eating the cereal, she found out, to her dismay that CRUNCHBERRIES ARE NOT REAL FRUIT!!! She sued, on behalf of herself and all similarly situated consumers who also apparently believed that there are fields somewhere in our land thronged by crunchberry bushes. http://www.loweringthebar.net/2009/06/reasonable-consumer-would-know-crunchberries-are-not-real-judge-rules.html Judge Morrison England Jr. of the U.S. District Court of Eastern California approved Pepsi's motion to dismiss on May 21, noting that the Sugawawa's attorneys were the same hillbillies who tried to sue because Froot Loops had no real froot. hmmmmmmmm.......guess it's time to switch to Frankenberries............Frankenberries ARE real fruit you know....... do they even still sell Frankenberry???

I'll just have to get my vegetables instead... There are clovers in Lucky Charms afterall! (I just avoid the horseshoes. They are a bit hard to digest!)

Yum yum yum...unfortunately i only tasted it once and that was like 3 years ago when my relatives abroad bought some of that. hmmm reminds me i should ask them to buy it for me. have a nice day.

I am not sure about the Frankenberries, But what about Mullberries it would seem that people don't get close to the tree because they are afraid to be mauled...lol by the berries. That is like trying to sue the diaper company cause it doesn't keep your child jnice and dry like it says.. I'm a hillbilly but I can tell you I feel my IQ getting higher everytime I learn about things like this..guess I am not as dumb as I thought.

Bwahahahaa - crunchberries are not real fruit? Hilarious! It reminds me of an April Fool's trick they played over here one year - they said the spaghetti crops were failing because of drought! The telly had pics of trees with spaghetti draped all over the branches. Plenty of people believed it. I'm guessing those were the people with the crunchberries growing in their backyards ...

You have to be kidding me! What some people will do to try and sue! Did she really believe that Crunch Berries were real fruit? Even I knew better than this when I was a kid! How daft is this woman? This has to be to ranked up there with the McDonald's incident that occurred years ago. Too bad this woman actually won her case. Because anyone with half a brain would know better to be careful when it comes to hot coffee. Sheesh!

sorry wouldn't know anything about CRUNCHBERRIES coz i have never heard of them before but if you are going to have Fruit roll ups instead try the sour ones ohhhh they are the best and of course I bet they don't contain any fruit either hehehe

Pepsi-cola for the prosecution should be a very good response .and protection of their rights .i agree.
