Hello crappy day!

I got up this morning and was so sick I went back to bed. My neck hurt and I had a minor migraine. I went back to sleep for a couple of hours, but unfortunately didn't have the brains to stay in bed...stupid me!
Bill stopped in and we went for our usual ride around the neighborhood, and I started to feel better...until... Well as soon as we got back to my house I had to go to the bathroom, and settled my fanny down on the throne for a leisurely read before I tried to do something else. YEAH RIGHT!!! I was just getting into an article in one of my magazines when there was a bang on the door. I thought it was Bill but the dogs gave off their "A STRANGER IS HERE" bark. So I finished up in the bathroom in a hurry and raced for the door. Another bad mistake!
At the door was a process server, serving me with papers stating that I am being sued in small claims court. AW CRAP! I posted in February that I had borrowed a 87 year old neighbor's sewing machine and she decided that the one we returned WASN'T the one that I had sold her 8 years ago. She went ballistic and when my boy friend Bill tried to tell her that the machine that I returned was really her machine, she hit him. Then she threw both of us out and ordered us to "take the piece of crap sewing machine with us".
I then got a call from the husband and was informed that I sold her machine. UHHH WTF??? I told him I didn't but I would buy the machine back from the wife for what she paid for it, $800. After all she bought it and put it in the storage shed and hadn't used it for 8 years, she didn't even remember the machine. I had to tell her about it. The next thing I knew I was informed that I told them that I had sold the machine and she was claiming that the machine was worth thousands of dollars. Okay...where did she get her information? On ebay the machine is selling for $800. It was a Bernina 930 that she is claiming that I sold her. The actual machine is a New Home Memory Craft 8000 sewing machine. Which at the time I sold it to her was worth the money she paid for it.
I have contacted one of the two people that bought machines from me for statements of when I sold the machines to them. Mom and I had both bought Bernina 930's back in 1985. I sold mine before my Mom died, and sold hers to her best friend the year after she died. I sold the crazy lady Mom's New Home in 2002. I'm not too upset over the suit. I have my doubts that the judge would grant these money hungry people $3000-$4000 for a 25 year old sewing machine. I have the New Home in my house and it is still in the case waiting for the dust to settle. I am more than willing to buy the New Home back and would be glad to pay the money back to the woman, but not the thousands of dollars she is demanding.
I should add that she is showing signs of dementia and she has had several severe strokes. I also know for a fact that she visited a friend in Medford Oregon during the holidays and I am almost positive that she used the friend's sewing machine.
Have any of you gone through this kind of crap? If so how many tranquilizers did you end up having to take? At least Bill can testify that the case on the machine was the same case on the machine that he carried out of their storage shed.
Just sign me "Going nuts in California" These people were like parents to me...and I wouldn't do something so awful to people that I was so close to, let alone anyone else.

I remember this and I thought it had all settled and sorted out
I just can not believe this at all and I am surprised that the court has accepted this to be honest

Will she be done for hitting your Boyfriend? I just do not get it why People have to go this far

Like I said before their entire lives have revolved around money. When it comes to money they have NO friends. Even when I offered to pay her the same amount for the machine that she paid me she claimed the machine was worth thousands and thousands of dollars. I am fairly sure that there is serious brain damage from the series of strokes she has been having.
I knew that the pair wouldn't leave the matter be, and that they would be suing me for whatever they could get. I had hoped to get it settled in a friendly manner but so much for hoping. What my problem is now is not only the sorrow and frustration at not being able to reconcile the problem in a friendly manner but my boyfriend lost a pair of friends. It strikes me that I am the typhoid Mary of relationships for this wonderful gentle man. To say the least this whole mess has my attitude back in the toilet and I am very depressed at the situation.
The main reason that things go this far is simply greed. I have been informed numerous times of how much money they have in the bank, in the house, how many diamond rings and necklaces she has and so on. Much of the money they have obtained has been from lawsuits.
WARNINGDon't spit on their sidewalk they'll sue you!

Oh I am so sorry loverbear..I was having a really bad day until I read this. (I posted about mine, but it isn't nearly as bad as yours..) I hope that it goes well, sometimes we feel backed into a corner and next thing we know, a door or window is opened and things work out..:)

I am hoping things would work out, but the couple are VERY money hungry (they're the kind that you hear about, Money is their God). I don't see settling this thing out of court, the only way that could happen is if I settled for the $4000 she wants for the $800 used sewing machine.
I think the worst thing about all of this is that I messed up Bill's friendship with the husband. But of course the husband messed up too as with Bill's attitude now, the carburetor that he was going to give the man is a thing of the past. The carburetor would have been worth about $1000!
As I said to Bill this morning, I'm not worried about court; I am not that easily riled to where I lose my temper and call people names and such, it's just the hurt from two people that I felt were friends and I had adopted as parents.

Oh Loverbear, you arent the only one. I had the day from hell and I think its carrying over until this morning. I watch peoples court all the time.lol When I have time. Anyways, try to find the bill of sale and any documentation you have regarding the sewing machine. Whatever you do, dont let yourself be sucked into name calling no matter how ridiculous these people are. People get a notion in there head and automatically they're right. Just try to remember if there was anyone else that remembered the situation. Good luck. dl

I did a paper purge a few months ago and guess what went. I recycled the paperwork. I'm not too worried about the suit. I know the woman really well and she is very apt to start carrying on during the hearing. I am getting documentation on the previous sales of the Berninas and I also am getting literature on the older models and the newer ones so she can SHOW the court and myself what machine I supposedly stole and sold out from under her. My big ace is Bill, who carried the sewing machine to our vehicle. He definitely remembers the cover to the machine.
Fortunately I never got into the name calling game. I figure that the woman will pay for all her name calling and hurts when she passes away. Right now the suit is more of an annoyance than anything else. I have decided to limit my contact and friendship with people, and if I do sell anything to a supposed friend I will document the daylights out of the sale.

Thanks for the offer of tranquilizers, I may need them. I know I am in the right, and even if I got judgment against me I can't see where they could get that much money for a 25 year old sewing machine. They had to have looked at new Berninas to get value. I can get the darn machine from ebay for $800-$900! The couple has a huge history of filing lawsuits when they feel things didn't go their way.
Neither my boy friend or myself slept well last night. We both are extremely hurt and angry at the crap being pulled. But as I said to Bill (My boyfriend) this morning, it is fortunate that I am even tempered and don't fly off the handle easily. It will serve me well in court.
Hummm, I just had an idea! I am going to check with the two people that bought the Berninas and see if I can borrow the case. I'll bet dollars to donuts that she wouldn't recognize the machine but she would recognize the case! I might even go so far as to try to get one on ebay.
I will go into court prepared for the worst. I also will have pictures of the machines and cases etc that I get from ebay to see if she can really identify the machine she supposedly bought. I do know that IF there is a judgment against me I will pay it of at $25 a month. If they get the $3000 - $4000 they want then it will take the rest of their lives to recover their stinking blood money.
What is interesting is that I am holding back on filing a leviquin suit because I don't want to end up being a money grabbing law suit filer, and I end up getting one of those darned suits. Go figure.
Thank you for the hugs, I really need them. I feel like I got run over by a steam roller and then the thing backed up and rolled over me again. I am in such awe because we have been there for the couple for the past 10 years. The guys have rode motor cycles together, when the husband set himself on fire we took her to see him at the hospital that is 150 miles from our home, we brought him home from the hospital, fed their cat and took care of their yard when they went on trips and more. So much for being a good friend!
