Why Does the Verbal Contract of Marriage Get Less-Respect than the 'Secret' Marriage-Contract?

I asked the Don'tPayFull-forum whether death was the proper way of fulfilling the 'marriage-contract.' I was of-course referring to the only marriage-contract I've ever 'studied'---the contract witnessed by all parties gathered to the couples' wedding-ceremony. But--as you can see from the response to it--no one believes that THAT contract is valid! When did 'the conditions set forth on a piece of paper buried within a file-drawer' become more-powerful than 'the conditions listed in front of all the participants' nearest-friends & -family'?
