Court tomorrow!

Okay, everyone, I had posted a discussion before about how I had served my daughters father with custody papers. Well, tomorrow is court day. I know he doesn't even know that it is tomorrow, he still never wanted another copy of the papers after he threw out the ones that he was served with. He never asked me for any information about the case, and to be honest, I wasn't going to give it to him if he didn't ask. So anyway,I am a little nervous regardless of the fact he won't be there. I am hoping that everything goes smoothly and that the court will go ahead and just settle the case. My lawyer said that it is possible that this could be drug out to two or three different court dates even though the other party has not responded and we know he won't show up.

i wish you good luck but i'm confused on what your going to court over...are going for full custody? do you now have joint custody? or does he have custody? or are you asking for child support? whatever the case i hope everything turns out in your childrens best interest

I am going for sole legal and physical custody. Right now there is no kind of custody order. We were never married. She has been with me for her whole life. It was getting difficult to do things that would require both parents to sign or give their consent. Most things he wouldn't sign just to be a jerk. He hasn't seen her in months, and lives in a different state. He just really doesn't care.

Good luck! I hope that if he doesn't show that they do rule and settle the case- If he is not smart enough or doesn't care enough to show up for his own child- DOn't drag it out! Good luck getting custody of your child. I'll be thinking positive thoughts today! I think it is today! Good Friday! I hope the name rings to be true for you!

Stories like yours make me glad my oldests sperm donor just fell of the map and I never had to deal with him. He wouldn't sign her birth certificate, which is probably the best hting that could've happened for her. Maybe you'll luck out and the judge will just give you sole custody for reasons of default(the other person didn't show.) It sure would make for a Happy Easter present for you! Yeah!!!! It went good. He is not in default yet, he has until next wednesday to respond. So of course the court wasn't willing to rule completely yet. They did however give me temporary sole custody until May 22. That's when I go back for mediation. I know he won't show then and they pretty much said if he is there then, I should have no problems. Hey honey - I think you already know how I feel about this wonderful role model of a father! Try not to worry ( know that this is hard but please try anyway!) just think you could actually get her passport and not have to worry about him trying to be difficult anymore! If the courts have any sense and see how you have already been treated by this man it will not be dragged out any more! Wish you every luck and will be praying ... hard! xxx

It went good. Of course he didn't show up or have any representation there. They were only willing to give me temporary custody until May 22, I have to go back then. The judge also made an order that I can get her passport and take her on the trip with us. I am so excited. It wouldn't have been the same without her. Thank you for your support.

I am so pleased about the passport honey - that makes a huge difference and will help keep you positive! If your charming ex doesn't turn up next time then the court will hopefully see that he is unreliable and award you with permanent sole custody!
