Here I go about our neighbors again.. UGH! |
| |
| Our yards are pretty close together in a neighborhood Last Sunday they had a big party in their yard. Now our dog Rebel is very protective and being part Dalmation and Lab he is a runner. He ran away so much when he was a pup and got put in the doggie jail a few times and had to bail him out with cash that we finally came to the conclusion that it was time to get a shock collar. This way he can't go past the electric barrier of our yard. Well as the neighbors party was going on two toy airplanes of the kids came flying into our yard. This kid about 15 years old came running into our yard to fetch the toys. As soon as he did Reble charged at him. The kid took off running and screaming as Rebel chased him. I immediately went out to the back yard to see if the kid had gotten bit by Rebel cus the kid was screaming as he ran. As soon as the kid saw me he yelled "put a leash on that dog!" I said "he's got a shock collar!!! Then the kids' father piped in saying that we should have Beware of dog signs up...and that Connecticut law states if you don't have beware of dog signs up and your dog bites someone then you are liable.... I said "NO and that the kid should of asked me to get the toys for him." I walked away before I said something I would regret because these were people at the neighbors party and not our neighbors themselves. I went inside and looked it up online to see who was right about the signs. And I found that the law states if someone is trespassing on your property or harassing your animal then we would not be held liable if they got bit. I guess I just needed to vent here about this issue because it has been eating at me ever since. What are the dog laws in your state? Do you know? I hope this discussion will help some one to place a beware of dog sign out side their home if that should be the law in your state. | | | | | |

| | In my state of minnesota we are required by law to have out pets in an enclosed area such as fence or kennel etc. We are to have then licensed with shots updated every year. Licenses every 2 years. We are also to post a sign about warning of a dog. It is then our responsilbility if the dog bites anyone. Wether they were in out yard being asked by us or jumping the fence to get a toy etc. We are the owners therefore we are responsible. A shock collar in Minnesota does not constitute the dog being in an enclosed area. So I would check further into your states law around dog ownership etc before getting irate at the neighbors. | | Do you have a regular fence as well as the electric fence? Because that kid (and his father)should have had better manners than to hop your fence without asking anyone. I'm sure your meighbor would have informed them not to do it, since I'[m sure he knows how your dog is. We have a 6 ft tall privicy fence around our yard, so we never really have thought about what the laws are, but I'm pretty sure if someone climbs the fence and gets bit, we wouldn't be liable, but I'm not so sure that would hold true if there weren't a fence enclousing the area, even if it is still my property. We actually put "beware of dog" signs on our fence just to keep people away from the fence and house. Even though the dog isn't really dangerous, he makes a lot of noise when someone comes near the house or fence. | | | | | | |

| | No their is no fence at all just a break in the hedges which is about an opening of 15 feet between our yards. but I saw the toys come into the yard a few times before this incident but Rebel was not paying attention to them coming into the yard when they fetched them the first few times. But the last time I guess because the kid ran into the yard Rebel ran after him. He probably felt threatened when the kid ran into the yard that time. Rebel wouldn't hurt a flea. His bark is worse than his bite! But I know one thing as well....I may just put up some big ugly BEWARE of dogs signs pointing at that neighbors yard and I know he won't like looking at them at all and he can thank his rude company for it too. | | | |

| | In Minnesota and most states I believe the owner is always liable even if the incident occured due to an unwanted visitor in the yard. There have been case where a crrok was bitten by a dog and the owners were liable for damages caused by the bite. Even though the man broke into their house and the dog bit him inside. Unreal but true. There's all sorts of tales like this of criminals etc suing others for things that happened because of their criminal actions and the owners are held liable on their property etc. HAPPY POSTINGS FROM GRANDPA BOB !!~ | | | |

| | Although tresppass is against the law here too, I think if a person was bitten by a dog, even whilst tresspassing, the owner of the dog would have hassles. I agree with you, to be honest. You have done the right thing by having this shock collar, &b there is no need for you have him on a lead in your own home. People should NOT be trespassing oin youyr people. Kids should always ask first if they want to retrieve a toy. | | | | | | |

| | In our country it is always the owner's liability whatever are the circumstances when a dog bites someone. Even if the person provoked or went inside your vicinity, but if gets bitten by the dog, the owner has to pay or shoulder all the expenses incurred. | | | | | | |

| | we dont have a dog (its not allowed in this apartment and besides, we are total cat people and would choose one of these if it were not forbidden too). But good that you could look up online what laws there are in your state. The kid has been irresponsible to just go and get his toy plane himself instead of ringing the doorbell and asking you to let him. How irresponsible can someone be with 15 years old that young one should have had a little more brain working. I would never have done this. | | | | | | |
