No more home schools! But they are closing schools left and right

I had to copy and paste this because on one hand they are closing schools and forcing parents to home school and then they turn around and say parent can't home school. So whats it going to be?
California court: Home school parents must have teaching credential

LOS ANGELES - California parents without teaching credentials can no longer home school their children, according to a recent state appellate court ruling.
"Parents do not have a constitutional right to home school their children," Justice H. Walter Croskey wrote in a Feb. 28 opinion for the 2nd District Court of Appeals.
Noncompliance could lead to criminal complaints against the parents, Croskey said.
An estimated 166,000 students in California are home schooled, but it was unclear how many of them are taught solely by an uncredentialed parent.
To earn a five-year preliminary teaching credential in California, a person must obtain a bachelor's degree from an accredited college or university and complete multiple examinations.
Until now, California allowed home schooling if parents filed paperwork to establish themselves as small, private schools; hired a credentialed tutor; or enrolled their child in an independent study program run by an established school while teaching the child at home.
The state left enforcement up to local school districts, but there has been little oversight.
The old system "works so well, I don't see any reason to change it," said J. Michael Smith, president of the Virginia-based Home School Legal Defense Association.
The ruling stems from a case involving Phillip and Mary Long, a Los Angeles-area couple whose eight children are enrolled or have been enrolled in Sunland Christian School in suburban

Sylmar and occasionally have taken tests there.
But the children were educated at home by their mother, who does not have a teaching credential.
Attorneys for the state Department of Education were reviewing the ruling, and home schooling organizations were lining up against it.
Phillip Long vowed to appeal to the state Supreme Court.
"I have sincerely held religious beliefs," he said. "Public schools conflict with that. I have to go with what my conscience requires me."

The hsdla is working on fighting this and other unjust things that happen to homeschool families.
They are trying to pull some stuff in our state also, where they are forcing parents and children that want to drop out (though I wouldn't let my kid, I see how it can be the best for some, it turn out the best for me.Though I had to work hard as an adult to get my education.)They are now saying they have to homeschool them, they found a loophole, and the parents don't know they don't have to, they schools here are telling them it is law and its not. I live in Indiana if you were wondering.

This story really bothered me when I first read it in the paper here several weeks ago, but in the article I read it also stated that Governor Schwarzenegger was not happy about the court's decision. He expects the higher courts to overturn the decision and if they do not he will be encouraging legislation to the protect the rights of homeschoolers. It will be interesting to follow this story. I also laugh when I read the remarks of Justice H. Walter that "Parents do not have a constitutional right to home school their children". Where is it in the Constitution that my children HAVE to attend school? As I recall it only says that my childrn are entitled to an education, it does not say where that education has to take place.
