who's to blame?

Today,we were driving along in our Jeep when all of a sudden this German Sheperd came out of nowhere!We quickly braked and the dog pounced down in front of the car before finally running after another car!!
So imagine we ran over this dog,who should get the blame?Us because we didn't brake fast enough or the dogs owner because he has left it outside near a busy road and that his dog is playing with cars??
(don't worry we did NOT hit the dog he is fine!)

Well I say it would be the owners fault. But then, the dog should know that a car is bigger than him too. j/k
Some dogs chase cars, some don't... I wonder why this is? We have dogs in our neighborhood that chase cars while the others ignore them and get out of their way.
None of these dogs have been trained at all. Maybe there is more to the mind of a dog than we can ever know.

That would be the dog owner's fault without a doubt. Dogs should never be left outside unattended if not in a properly fenced in yard, and that dog obviously didn't have a fenced in yard if he was able to get out chasing cars. And at least in my country the dog owner would also have to pay for all damages, if any, made to your car if you had run the dog over. Dog owners are always responsible for all damages their dogs do.

The owner, unless someone is driving too fast of ourse but if youre driving safely and an animal just jumps out and you hit it of course its the owners fault they should have made sure its secure!
