refusal to return rental deposit

5 adults rented villa in PDC owned by US resident; owner refuses to return deposit, citing stains on bed linens which were clearly visible when we arrived; Playacar Beach Rentals, owner's rental agent in PDC, has not responded to our emails dated 6/24 and 7/2. Is this an error? A swindle? We are investigating the possibility of suing in small claims court, since we rented in US, owner lives in US, General Director of rentals agency has US address and we paid in US dollars mailed to US address. Anyone had any similar experience? Comments? Advice?

did you sign any forms that stated anything with regard to the deposit being forfeited in the even of damages [in this case, the stains] on the property? you should have complained at the beginning of your stay or upon arrival about the stains or anything else that you found not to be in good condition. you can probably do a little research for cases referring to the owner filed by other people and see if he's had some history.
