This is sooo sad. Due to her fear of my brother she failed to show up again. At least he has the drug possesion charges as well as felong bond violation charges.

A Superior man accused of setting fire to the bed where his girlfriend slept will no longer face a felony arson charge in Douglas County Court.
The charge against James Leo Olson, 50, was amended to a misdemeanor charge of negligent handling of burning material Tuesday after the alleged victim, Lynn Bergson, failed to appear in court to testify during the third preliminary hearing set for the case.
Bergson failed to appear at the initial preliminary hearing on June 27. At the second hearing on July 9, Olson didn’t appear and a warrant was ordered for his arrest. The warrant was never issued because Olson appeared later that morning.
Police reports indicate Olson, who is blind, started a mattress on fire while Bergson was sleeping on it. The incident occurred in their apartment at 1116 Hughitt Ave. in the early morning hours of June 11.
The two had been out drinking before the incident and got into an argument when she wanted to go to bed and he wanted to stay up, according to reports and the criminal complaint.
“[Olson] never claimed it was an argument; he only claimed it was a loving exchange,” Officer Thor Trone of the Superior Police Department testified during the first preliminary hearing.
Bergson fell asleep and woke to Olson saying that he lit the end of the bed on fire, the complaint states. It was burning, she told officers, and she was unable to put the flames out.
Superior firefighters were called to the apartment at2:54 a.m. and they cleared the scene at 4:17 a.m., according to Superior Fire Department records. An estimated $1,000 in structural damage and $1,500 in personal property damage were reported.
When police questioned Olson, he said he was smoking on the bed and it somehow started on fire.
“I don’t believe the fire was caused by smoking,” testified Trone, an arson investigator for the Superior Police Department.
While a cigarette in bed can cause that kind of damage, he said, there had not been enough time for one to have caused a sustained burn.
When Trone and Officer Adam Poskozim brought Olson in for questioning, he changed his story.
“After the issue was pressed, that’s when he said he was lying down trying to light a cigarette,” Trone testified.
The Superior man also faces a misdemeanor disorderly conduct charge, a felony bail jumping charge and an ordinance violation of possession of marijuana. His next court appearance is set for Aug. 20.

I do not know what to say to you friend, Fear is a powerful thing. Does she also say "I still love him?" Victims do that a lot. They may be able to get him and keep him awhile on the other charges. It is hard to accept the stupid and dangerous choices that others make, especially if they are family.

Just wants to make you throw your hands up and say "what the he$$", I am sorry to hear this Grandpa Bob, I am assuming this whole thing will blow over and your wonderful brother will be allowed to do more criminal mischief in and around near you, I am sorry for your pain.

So your borthers charges have been reduced now, because the ex girlfriend wouldn't turn up in court. It's hard to believe that she was really scared of your brother, I mean ,what can he do to her in court? Especially being blind.
I reckon she has exagerated.
Still, at least he has lesser charges now. I wonder if he will get a jail term?

Wow, I thought it was so sad when you originally told us the story; however, it keeps getting worse. Your brother just keeps making it worse by his behavior. I hope he gets help soon.

So because she is too afraid to go and stand up in court- he isn't being charged with a felony anymore- That is too bad- I was hoping he would get the help he needed if he had to do time- Hopefully she has moved on and is safe- Wow-- it is true you can pick your friends but not your family-

My GRANDPA BOB you sure do have your hands full with your family members....It's a shame that your brother's girlfriend didn't show up, but that's how the judicial system works....When my mom and I had our own court thing due to an eviction issue we HAD to show up, if not, by default the landlord would have automatically won his case...so the same thing here...Since she didn't show up the case was practically thrown out of court..right? And more in favor of your brother...if you can believe that!

It's very sad that your brother's girlfriend didn't show up, and hence, the lesser charge, Grandpa Bob. I believe like you, that he must be threatening her with serious harm, outside of court. It's not good that he's got 'friends' willing to help him either. I do hope that his girlfriend doesn't suffer further injury, because she didn't make the appearance.

After reading all the responses I see that you have posted something about your this brother earlier. Unfortunately I haven't read it. But this story itself explains his irresponsible way of living. It seems he has escaped from one charge by virtue of his ability to frighten the lady. But other cases are still pending. Let us hope he will get maximumum punishment for his crimes. I am sorry he is your brother. But you are in no way responsible for his wrong doings.

the first thing that comes to mind is it takes all kinds to make the world go round lol. there is no telling what really happened and to be honest there are only 2 people maybe 1 that really know the truth of it all. if she is scared she may just take flight. if she is in love she just doesnt know what to do probably and is trying to figure it out. or she could just be nuts lol. i can understand you stanying away though. i stay away from most all my family cause they are all trouble and i dont want that kind of life for me and my kids. sad huh? i hope your brother grows up someday and the two of you can make a go at it. you cant change people no matter what you do or say they have to want to change so until he does you are doing the right thing. i would keep track though cause if anything you may want to write him someday. good luck and i hope he grows up soon before he hurts someone badly or someone hurts him

thanks for the update grandpa..your brother may not learn his lesson because the girlfriend got scared and did not show up.she can have security with police to request isn't it? i wonder why she did not do it..i hope your brother will not repeat this again..
