His carelessness-my headache

In February 2011, I was paid ‘arrear salary’ from the college I served last, prior to my retirement in April2006. They deducted income Tax @30% at source; this amounted to 34, 768.00 rupees. As per income tax rules of my country, this has to be deposited in my PAN (Permanent Account Number); so that this may be adjusted with taxes that I paid for financial year 2010-11, assessment year 2011-12. Now I discover from ‘Form-16’ showing ‘Tax Deducted at source’, that, they have deposited this amount, not in my PAN, but someone else’s PAN, in place of …..35 they typed …37. I have written several letters, made several calls to the present Principal, but work has not been done. Just wonder, how careless some persons are, they are the present principal and the clerk. [b]I will wait for 10 days more, before going to court of law. I feel so bad; this causes stress and affects my health. Guess I am doing right; let the law punish them. Professor Sir: The amount you have mentioned is a sizable one which you may be applying for refund as per rules. I suggest you consult your chartered accountant also --whether there is any way--The person for whom it has been credited may not be aware of it and hence possibility of his claim may not be there. I wish your problem to be sorted out early.

Hello Papa! I am sorry to hear that they made this careless mistake. Yes it can be very stressful and I do hope they take care of it for you soon. One time a Certified Public Account made a mistake on one of my tax returns and the IRS did not catch it until 7 years later. It was in fact an error of the CPA but our government says that we are responsible for the CPA's error's because we are the ones signing the form and are completely responsible for their errors. The mistake means that instead of getting the $3500 I did get that I was only suppose to get $1500, so by the time they caught/audited the error it was 7 years later so they charged me interest of 27% per day for the seven years plus penalties. The end result is that I had to pay back $11,000. Oh my indeed it was a major headache for me. Have a great night.

I think you are being very fair and giving them plenty of time to retify things. I think You are doing all you can do under the circumstances. I hope that this doesn't cause you any great ill effects. I also hope that this gets taken care of the manner in which you need.

hi professor, sometimes people are just to careless at the expense of others. if they do not do anything to correct the said mistake, i think there is no other recourse but to sue and demand for alternative relief like make them pay for damages and sleepless nights of anguish and costs of suit. ann
