Marital Rape - a legalised form of rape?

Nowdays there have been enourmous disscussion about marital rape. A lot of you may not be aware of the existence of such a henious crime in our society. A marital rape is a form of rape. Where the husband imposes himself on his wife . There are no particular laws in India against such a shameful act .the question arises why are there no checks on such things and why the government does not take action against it ?
Just because the individuals are in a union of marriage , sexual harrasment and molestation is accepted ?. But what more shocking is the fact that society recognises as a social obligation of women ., to satisfy the needs of their husband . I think its high time and the government needs to take quick actions against it.

Does there need to be specific legislation?
As long as it isn't permitted in law then just the normal legislation would suffice.
A man rapes his wife, wife reports it then man is arrested and prosecuted.

Well firstly there is a diffrence in laws in india. There is no law against it. And if someone commits such a crime .there is no law against to punish the man

@Lazyblogs there doesn't need to be a law against it though.
There are already anti rape laws in India.
If there is not a specific law that says a man CAN rape his wife then just use the normal rape laws against him.
It's irrelevant if he's the husband as there is no law that says a man CAN rape his wife so if he does he can be prosecuted under the rape law.
Its just like murder.
There's no specific law that says a man can or can't murder his wife but there are laws against murder.

I agree with what Mike said ... there should not be the need for separate legislation, because rape is rape regardless of whether or not you are married. That being said, I do understand that it is not viewed that way by many. I would much prefer seeing people's attitude's and thinking change and enforce the laws that are already there rather than making new laws to cover these circumstances. We have separate domestic violence laws but really those actions should just be covered by the basic laws already on the books.

Well if it is not regarded as rape only so how can rape laws be used for it..a new law or a change in the existing laws should be made

@purplealabaster married women were never the subject of rape laws. Laws bestowed an absolute immunity on the husband in respect of his wife, solely on the basis of the marital relation.

I think marital rape is altogether different topic than conventional rape because here the woman seems to have no rights to say no...whatever be her needs at that point of time. I think her rights need to be recognized and she needs to be treated as human rather than some animal or inanimate object.

@vandana I disagree with you here. Women HAS the right to say no as much as the men do. They haven't recognized it yet. They comply due to social standing, family honor, the ridicule,etc... Once they have broken these shackles you would see how much change is brought into our society.

That mindset is so outdated that it isn't even funny anymore. I think marital rape should be recognized now in our country. And that would be a good thing. The only issue I see here is that women nullify any improvements made themselves when they start misusing the law.

It's pathetic. The laws simply state that once you are married, it is one of your duties to be raped. Once you are married, you are no more a human, you are just a property. It is such a shame that such laws still exist.
