Little Brother

After we got out of the doctor's office today, I got a call from the Sheriff's Department. My little brother thinks I should be charged for cutting the lock off the POD although the POD did not belong to him. The officer stated he was trying to figure out if there was a robbery. I told him the situation and he was satisfied. Ten minutes later he calls back and said that my brother claimed some of his tools were missing. I told him I didn't take any of his tools and that they were all put in the storage room at my mother's suggestion. He thanked me for my time and hung up. Call number 3 came a few minutes later and the deputy asked who owned the house. I said, "my mother. She is sitting right here. Would you like to speak to her?" My mother confirmed that she owned the house. He then stated that my brother said that the house was in his name. My mother said no it is not. Then he asked her who had power of attorney, my brother or me? She said neither one of them do. He said well he has a paper here that says (girlfriends name) has power of attorney. Shock to me. My mother said she signed a paper for Mandy to handle getting her house fixed. My mom thought it would not be vaild since there was not a notary present. Apparently, according to LA law, it is valid but not for the selling of the home. This goes to show that they were trying to get mom's house all along. My mother was in a state of shock. I am hoping that she will now do something and file the fraud charges against both of them so all of this can be over. Oh and the neighbor called me after the police left. He told me my brother broke into the house and changed the locks. He also cut the lock off of the POD. I had given him the combination, but I guess that was too hard for him to open it the correct way. Geez. My mom was tired after her doctor's appointment so we headed back to my house. I am not taking my mother there in the morning because she has a test right after lunch at neurologist's office. She does not need to be upset any more than she is. I will be contacting the sheriff's department and letting them know he filed a false report saying that the home was in his name. He should be charged with a misdeameanor for that.

@wolfgirl569 I'm waiting to see how she handles the face to face confrontation with him. She mentioned today that she would go to the other property but that house there is falling down and was supposed to be torn down. I told her that house was not livable but why should she be booted out of her house. I told her I'm with her on this and will fight to get her back into her house. I'm wondering just how they threatened her because it does sound like they are afraid of her saying something. Oh wait...she may tell the cops that they stole her FEMA money. Bingo.

@kareng Getting her back into the house could be a big help with her mental state. Hope you can do it soon. It might be worth installing a security system also if you dont have one. It sounds like he is escalating fast.

i'm still confused 's to why the neighbor's not callin' the police? such should'a been done if'n he broke 'nto the house 'n changed the locks 'fter y'all left. 's fer that paper yer momma signed? i'd sure be seein' a lawyer 'bout such (did'ja get a copy??) 's she'd no doubt dementia 't that time, though not yet diagnosed.

@crazyhorseladycx It doesn't have to be filed or notarized. The only thing she (gf) can't do is sell the house. And this is just speculating that she has full POA. All of my things were packed by my brother and who knows where this ended up. Plus we can't get in the house right now because I know he changed at least one lock. Why stop there?

Because at the time my mom had said we both have access to the house. The cops wouldn't do anything about it with that statement on record. This was before he pulled out the POA paper. And no, she does not have a copy at present since her whole house was packed up for renovations after the flood. She has no clue where the copy is now that she once had.

Here the UPS had an on duty notary. Have your mother to revoke their POA. Here is a link, I know someone who had to revoke a fake one, they did like that woman did your mother. AND you should not be a witness.

Thank you, Andria. She does not even have a copy of it. I'm sure it will be thrown in my face as soon as I see him. I just hope he blows his gasket and shows his behind. This may wake my mother up good.

@kareng AND as far as I know, if she gives a new POA. say to you, it auto cancels the other. Just like new wills cancel the old ones.

@kareng Your little brother is too much. He is not nice at all. They should take him away. Can you change the locks so he cannot ever get in the house again and put an alarm system in too?

@kareng Do you know someone that can pick the lock and you can get in and get him out and change all the locks on him so he cannot get in anymore?
