The Latest on the Evil One

The evil one is still at it. He has moved his girlfriend and her two youngest kids into mom's house. The other 3 kids are all over 18 and living elsewhere.
I found out from a reliable source that there was another Power Of Attorney out there for all of mom's cash and property and other things as well. This put me on alert so we went to both banks that she deals with.
The first bank I had called last week and she told me yes, the evil one came to the branch near my mother's house. Upon reading the "notes" that were uploaded they took action. He presented his Power of Attorney and they told him they could not honor it. The account was put on hold. They tried to call my mother but only had her old phone number which was disconnected. I told the account representative that the POA is not valid. 1. It is forged Also, because of her condition, it is also not valid or would be hard to prove because nobody knows the exact date that she started with the dementia.
Upon our visit, I got a copy of the POA. The signature is indeed forged. I told them to look at her signature where she signs checks and also the signature on the POA. They readily agreed. I also brought up forged checks that were coming through and showed them the difference there. I was ticked off about this because I spoke to the branch manager while she was in the hospital and told him there would be no activity on this account and if there was, it was fraud. He was not a help at all as checks went through...forged checks. They all know him there now. He has visited a couple of times trying to get money out and they have told him that he is not getting into her account.
Second bank. He showed up there as well and presented a POA. This bank could not even pull a copy of it. But a form was filed stating he had POA. He managed to get $500 out the day he presented the POA. They asked why my mother was not with him. He told them she was disabled and could not move around. LIE, she can move around.
He came back again and wanted to take ALL the money out of checking and savings. The account rep that waited on him was the one that accepted the POA. She said that she "felt" something was wrong and told him no. You cannot take any more money out of this bank unless your mother is with you. He left. He came back the following day and sat in the parking lot. The account rep said that she felt like he was waiting for her to leave since he knew they would refer him to her to be waited on. He eventually left.
Optimal happening is that he goes back to either one and causes a scene and they call the cops on him. I know he has a bench warrant out for his arrest for an incident in 2018 when he failed to show up for court for traffic violation. That isn't much but it is a start and if the Office of Elderly Abuse has contacted them or vice versa; he will be arrested. This latter part we might can accelerate and are working on that
I imagine he will blow his lid if and when he goes back to either branch. Right now the score is Wicked One-0; Mom-2.

I'm livid because he was able to get money out and pass more checks. And now he's living in the house? I thought your mother was going to be living there. I wouldn't be able to sleep at night because I'd be so mad!

Oh yeah, he broke in after calling the cops on me because I changed the locks when I caught the girlfriend's son sleeping there. Cops called me 3 times and was happy with the info I gave him. After cop left, he broke into the house and changed the locks. Several days later the girlfriend and two girls moved in. And that is why I didn't sleep for two weeks.

Just so I make sure I understand everything clearly, you were able to handle things at both banks and ensure that he can't take out any more money? There's no way the bank can put some kind of fraud alert on the accounts that direct them to call the police if he shows up again? I mean, at that point they know is purposely and knowingly attempting to engage in fraud, so that is against the law, right? The banks should be able to have him arrested in my opinion.

Yes accounts are locked down to him at both banks. I would have thought they would do something when they knew about forged checks. No, my mother would have to press charges or the merchant the check is written on. I would think the bank would have to be held somewhat responsible and I'm going to talk to an attorney about that--getting her money back and also if I could press charges on her behalf since she has Alzheimers?

@moffittjc She hasn't given anyone POA. They forged the document. Yes, if it was valid the POA cold press charges on her behalf.

@kareng I think the bank would be liable if they didn't follow proper procedures in verifying who can have access to the account. I hope you are able to get it all straightened out. If your mother has given someone power of attorney, should the POA have the right to press charges on behalf of your mother?

This is both a headache and a heartache for you to deal with. I really hope he gives someone a reason to call the cops and get him arrested.
I don't see how he can live with himself forging the POA.

@kareng Yes, I was a little taken aback by the fact they didn't keep a copy. That seems like standard protocol to do. Someone was either slacking or just didn't know. Either way, they should have done better.

You got that right. The first was warned that he may put forged checks out there when I stopped when she was in the hospital to ask that her account be flagged cause she was nowhere around him to give him a check or sign a check for him. And the signature is very different. The bank should have caught it.

@CarolDM They did zilch in 2017. This time they have reports from hospitals also. She obviously said enough to raise some high suspicions and then he failed to answer phone for 3 days when they were trying to discharge her so they filed for abandonment.

does yer hubs not think 'tis past time to alert the police 'f this? since y'ave a copy now 'f that forged p.o.a., they ought'a investigate further. warrant fer his 'rrest? well, here's his address. i jest cannot 'magine someone treatin' anyone, much less their momma like this :(
're the utilities'n his 'r girlfriends name? if'n not 'n they'd be'n yer momma's, i'd get 'em shut off post haste.

I just wished the account was flagged so any man coming in cannot get anything. If the bank won`t honor her account and keep them out of it I would change banks. He wont know where to go then. Or close the account all together and get a direct express card for S.S
$500 is a lot of money.
Hey turn off the power, water, etc. at your moms house, she aint there anyways!

Not paying any electric bills. She has water and garbage coming out directly from the account at the crappy second bank. My name is on that account now so I can call them and have it cancelled. It will be cheaper to pay new deposit and all rather than to continue paying their bills.
