In my previous posts I mentioned about our land dispute and my filing of civil case against fraudsters. The defendant filed an ANSWER WITH COUNTERCLAIM and upon reading it I find defendant's lawyer quite inept and inconsistent by handling two legal documents showing different PRICES (that is Tax Evasion) and different lot BOUNDARIES (that is Land Grabbing). I have a working experience as an Executive Assistant in a local Aviation Company for several years and is very confident I could prove "my claim" to the Honorable Court even without a legal counsel to represent me. For me... It's just a matter of simple analysis of the civil case at hand. A good lawyer will see that I took legal action to protect the interest of my family. Sorry, but even a lowly streetfood vendor will be able to comprehend the issues embodied in the civil case that I filed. What happened is like "BUY 1 TAKE 3". I still have the courage and confidence in pursuing my family's land dispute with the court of justice. Preparing, validating, collating data, analyzing, recording and justifying all sorts of official and legal documentation are just a few of my expertise and main responsibilities while working in the corporate world. As an Executive Assistant I also reviewed Technical Contracts and similar legal paperwork in close coordination with our Legal Department. Because of my exposure to the legalities of business transactions and the previous civil case "won" by my parents, I find no reason why I cannot cope and handle a case pertaining to a land dispute. The defendant's counsel also filed a COMMENT/OPPOSITION WITH MOTION TO EXPUNGE and insisted it in the pre-trial that my filed complaint and motion for extensions be expunged. The Philippine system is adaptation of the American and Spanish laws. If my understanding is correct, a MOTION TO EXPUNGE is appropriate for criminal cases and not for civil files. Motion to Expunge means to do away or destroy records relative to a criminal conviction. In other words, a motion to expunge can be filed AFTER JUDGEMENT in criminal cases and not before pre-trial nor after judgement of civil cases like the case that I filed. I wonder how that kind of lawyer passed the BAR Exam (LOL). She is only good in speaking/writing English but very unanalytical. Good for me, right? Any lawyer here on myLot? What is the legal action if you discover that after selling 3-lots with an area of 1000 square meters each (a total of 3000 square meters) the area in the Tax Declaration of your real estate property decreased by 4000 square meters?

For what I remember of American system, the expungement generally applies to records that did not result in a conviction, so I suppose it's only in criminal cases. Bad lawyers are a common good in our days.
