Update on my finical situation.

Okay, ellis, our lawyer, helped us out. He told me how to draft a reply that would look professional, and would hold up in court. It's designed to buy us more time. He also told us to clean out both our bank accounts and open new ones. So, that means a day spent doing those things. Which means more running around for us. And, as quickly as possible. Our house is safe, because we wisely homesteaded it. As long as I pay my taxes on time (which I have), the court won't touch it. The only way the state could get it, is if we both die or if we stop paying taxes. And, I was told, that we need to spend George's money, first. that way, the courts can't find it or find anything to take. He also didn't charge us. He told us he doesn't want us to pay for what will be a losing battle.

Sounds about like what I expected a lawyers response to be. We had to make new bank accounts this year after dealing with identity theft and all that. So I feel your pain in that department. Now I strictly Venmo and Paypal for our day to day shopping.

I'm actually trying to get my SSDI sent to paypal, because I've been using it for almost everything. I even successfully paid my discover card with it, twice. I plan on using it for the eletric bill, next.

@thislittlepennyearns I tried to do it online, then it said they need more information and I need to finish in-person. So, that's on the to-do, list. I need to get George a new bank account, too but that's going to have to wait until we get some money. Most banks require a first-time deposit to keep the account open. And, I honestly don't want to risk anything if I can help it.

@kaylachan Yeah Paypal has opened a lot more things then they used to. Even Walmart and Dollar General take Paypal which comes in handy. About half of my freelance stuff pays to PayPal and if i can use that for bills and stuff it saves otehr money for other things. I hope they let you!

I do hope it all works out for you, as I have said before. It's a touchy subject for me since I am one of those people who sit on the side of, "If you owe the money, you pay it." It's always funny to me that most people understand how it feels when someone owes them money and someone doesn't bother to pay it back, and they think that's wrong...because it is, but then justify doing the exact same thing to someone else. What if Social Security came around tomorrow and said, "We have to reduce your benefits because we made a mistake and can't afford to pay you as much." Even worse if Social Security COULD actually afford to pay you, but they just put the money somewhere else...in a hidden account. lol In situations like this I try to see the shoe on the other foot is all I am saying. The next time someone owes you $100 and leaves you standing empty handed...you can't be angry with them even if you know they have the $100 to pay you. In other words, by this logic, it's okay to cheat someone so long as you do it creatively. lol

Yeah, and I've been there. I hate doing it, but the truth is, it's a loose-loose. if we did have the money on hand, then we would've paid the debt long ago. But, the reality is, we don't. Not really. Sure, I am not spending money on ride share anymore, but I still have to pay taxes on my house and my home owner's insurance. I still have to pay for electricity, water, and the insurance on the van. As well as gas and groceries. While I'm not the hugest fan of this approach, I can understand where our lawyer's coming from. Sure we could argue this out in court, but that could cost us more time and money, possibly making court costs alone more then the debt, itself. Since the company has gone through the effort to sue us, it's no longer as simple as paying the debt and calling it a day. At the end of the day, buy the time all is said and done, we might not have enough to cover anything, and we won't know. Untill a judgment is reached. Now, had I remembered the account two months ago, we could've avoided a court case. but the rality was, I'd forgotten it and at the time mislead to believe the debt had been forgotten. You see, the debt in question is in George's name. While I did hear his phone once, when I talked to them, I explained what happened and offered to do something then-- their answer 'you're not responsible for the debt'. So, I let it go. I assumed, they'd write it off or something... or send it to collections or something. Nope. they s sued us, instead. Or, rather, George. So, we're just following the advice of our lawyer on this one, because I know that draging this out in court won't be good. Hell, going to the courthouse to file my (George's reply) is going to be a challenge. Because for some insane reason court houses are designed poorly.

@porwest hen we filed bankrupsy. I'm also thankful he didn't charge us, like he nrmally would, because he said he didn't want to get paid just to loose in the end.

@kaylachan All in all, like I said before, I hope it all least works out for the both of you overall. The lawyer, I am sure, will be able to find the best solution here. It's a terrible situation and I feel your pain. keep us posted as to what happens.

I bet you are very relieved to now have a plan and know what you must do to safeguard yourselves. Most lawyers cost a lot but as I experience life more and more, I think they are well worth it. All you have written here makes a lot of sense. I hope you can get all done quickly, with no hitches, and then you can breathe a sigh of relief.

Well, I don't follow your previous posts. I really think that, from what I see, it's a rather delicate situation. I imagine that you've had to go through a lot of bureaucratic issues.Errands and all those things, the truth is I hope that everything you are doing is for the well-being of your family and your home and that everything goes well and you have the best advice.
