It is totally within the judicial system's 'jurisdiction' to find that it's unconstitutional (as it is) to prohibit marriage on the basis of gender. It's all checks and balances. The original statement I commented on is something I don't understand why you have a problem with. If the law doesn't make something illegal, then it is legal, and it makes perfect sense for a judge/jury to reach that conclusion.
