It is totally within the judicial system's 'jurisdiction' to find that it's unconstitutional (as it is) to prohibit marriage on the basis of gender. After all, post-menopausal women aren't forbidden to marry, and neither are men or women who have had vasectomies/tubal ligation/etc, so it makes no sense to use 'same-sex couples can't produce children' as a reason to deny them marriage.

But it is their job to strike down or fix unconstitutional laws, and that is why it is their job to prevent unconstitutional gender discrimination from existing in our marriage laws.

It's all checks and balances. The original statement I commented on is something I don't understand why you have a problem with. If the law doesn't make something illegal, then it is legal, and it makes perfect sense for a judge/jury to reach that conclusion. |
