Dry Cleaner Being Sued For $65 Million Over A Lost Pair Of Pants

United States

The following story is the reason lawyers are so despised by many people. These people came to America, acheived the American Dream, only to have this Judge/ex-lawyer ruin it for them. I wish this case would be thrown out and the Judge be made to pay back all these people have spent defending themselves against this frivilous lawsuit. I feel so sorry for this family. What is your opinion. Here is the story. Jin Nam Chung and Ki Chung stand in their dry cleaning business, Custom Cleaners, in Washington, DC on Wednesday. The Chungs are being sued for $65 million over a lost pair of pants belonging to a local judge. The Chungs, immigrants from South Korea, realized their American dream when they opened their dry-cleaning business seven years ago in the nation's capital. For the past two years, however, they've been dealing with the nightmare of litigation: a $65 million lawsuit over a pair of missing pants. Jin Nam Chung, Ki Chung and their son, Soo Chung, are so disheartened that they're considering moving back to Seoul, said their attorney, Chris Manning, who spoke on their behalf. "They're out a lot of money, but more importantly, incredibly disenchanted with the system," Manning said. "This has destroyed their lives." The lawsuit was filed by a District of Columbia administrative hearings judge, Roy Pearson, who has been representing himself in the case. According to court documents, the problem began in May 2005 when Pearson became a judge and brought several suits for alteration to Custom Cleaners in Northeast Washington, a place he patronized regularly despite previous disagreements with the Chungs. A pair of pants from one suit was not ready when he requested it two days later, and was deemed to be missing. Pearson asked the cleaners for the full price of the suit: more than $1,000. But a week later, the Chungs said the pants had been found and refused to pay. That's when Pearson decided to sue. Manning said the cleaners made three settlement offers to Pearson. First they offered $3,000, then $4,600, then $12,000. But Pearson wasn't satisfied and expanded his calculations beyond one pair of pants. Because Pearson no longer wanted to use his neighborhood dry cleaner, part of his lawsuit calls for $15,000 — the price to rent a car every weekend for 10 years to go to another business. But the bulk of the $65 million comes from Pearson's strict interpretation of D.C.'s consumer protection law, which fines violators $1,500 per violation, per day. According to court papers, Pearson added up 12 violations over 1,200 days, and then multiplied that by three defendants. Much of Pearson's case rests on two signs that Custom Cleaners once had on its walls: "Satisfaction Guaranteed" and "Same Day Service." Based on Pearson's dissatisfaction and the delay in getting back the pants, he claims the signs amount to fraud. I find this lawsuit so disgusting. What do you think? Lloyd

I think that judge should not only be kicked off the bench, but should be disbarred, He is nothing more than a bully and a bigot. You can bet that if the dry cleaning business was owned by a college educated white man, there would be no law suit at all.

I really hope that the ethnicity of the owners of the dry cleaning business was not taken into consideration when this lawsuit was filed. That would make this case even more dispicable. Lloyd

F. Lee Bailey - image of F. Lee Bailey, famous lawyer involved in getting a not guilty verdict in the O.J.Simpson murder case.
If I were the Chungs I would file a counter suit against the judge in the amount of $75,000,000 for misuse of justice, for causing loss of business and defamation of character. And I would make damm sure I got some good lawyer like F. Lee Baily.....he helped get O.J. off he could certainly make a good case and I'd pay him the extra $10,000,000 for his services.

I hate the way people sue over every little thing these days, it seems people are just looking for free money in every way they can, mistakes happen everywhere and mistake can happen to everywhere, yes if you make a mistake one should reimburse a perosn for their loss but only at the cot of whatever, it is all becoming rediculous.

Hello Lloydanthony, Nice to visit with you again. Sorry it has to be over such a ridiculous issue. I heard about this lawsuit last week, and every time I've thought about, or heard it again -- I simply shake my head. If this doesn't epitomize what's wrong with our judiciary, I don't know what does. The very fact that this man has been promoted to the position of judge is absolutely unbelievable. How can he claim to have an understanding of fairness if this is how he perceives justice? Pity the poor soul who has to rely on him to adjudicate fairly!

Hello Ladyluna. It's also nice to see you again. You are so right about this Judge. I don't believe he has he character or moral fiber to judge anyone. I hope that all previous cases ruled on my this Judge is reviewed to make sure that he was of good mine. Lloyd

I do agree that the Chungs were careless with the pants. They supposed to have it ready as they promised, on the day Pearson needed it. The pants were only found a week later, so the least Chungs could do was paid $ 1000 the full price and didn't return the pants (they did say it was missing anyway so they were careless). But I agree that a lawsuit of $ 65 millions are just way too big. The pants' full price at first was only $ 1,000. He could've accepted one among 3 of Chungs' offers. I really hope the judge could see this.

The Chungs offerred up to $12,000 dollars for the lost pair of pants and the judge didn't accept it. I don't think my whole wardrobe including sheets, pillow cases, and everything else is worth $12,000. This is just plain old fashioned greed. Lloyd

I wonder if there is a statute somewhere saying the judge could be sued due to wating the taxpayers money for such a frivolous case and tying up an overextended court system? This is just the most ridicolous thing I have ever heard. So you can be sued for being human now? This makes me so angry. I wonder if I could sue the insurance company that promised me a "Hassle free claim" with the sign on their wall when their insured hit me and the process was anything but hassle free? It's situations like the one you described that makes me hope there is sucha thing as karma.

I hope there will be some way he will be made to compensate the taxpayers for this misuse of the judicial system. I agree with you. This the definately the most rediculous thing I have ever heard also. Could you imagine if he won this lawsuit how many more frivilous lawsuits would pop up? Lloyd

I read this on the sympatico website. I find this is a definite misuse of the American legal system. Someone suggested it might be that this judge is trying to make a statement and show how wrong and how ridiculous lawsuits are getting. Regardless, I feel badly for this drycleaning family.

Well I found a link to the article on this in case anyone wants to read it: http://www.allheadlinenews.com/articles/7007248063 You would think a judge of all people would not want to put such a nonsense case into the system. That he is taking things way too far in an attempt to get his 15 minutes of fame. He should be the one fined for such abuse. My thought is he should be thrown off the bench and possibly disbarred for unethical behavior. It's a shame that such people exist in our country and want to take advantage of others in such a way.

You and me both. I hope he doesn't get anything from it. If anything at this point he should be paying them. I'd be counter sueing for the bad press, the stress, etc. Let alone the fact that it's a frivelous case. He should be disbarred I agree. There is no reason for such behavior. He should know better.

I agree with you 100%. For a judge to do this makes it even worse. People should demand that he resign and picket his courtroom. He's looking for a easy way to make money off of these hard working people. Can you imagine how frightened they are of him because he is a judge. That's probably why they offerred him $14,000 to settle the case. I hope he doesn't get a cent. Lloyd

I read this story and had a good laugh. I understand that it's not right for someone to be stealing, but really suing over a missing pair of pants, come on. Those pants can be easily replaced, unless of course he considered those to be his lucky pants..haha. I keep wondering what the next stupid thing someone will sue over will be.

This type of stuff sickens me- All over a lost then found pair of pants- You know crap happens to put it nicely! What a joke this is- Abuse of power- I feel for the Chungs- Pearson is a total idiot- I hope Karma comes back to bite him in the end!

I agree. This is really greedy and quite disgusting. I would have asked for the money for a new suit and have brought my business elsewhere. I find it really difficult to believe that there are no other Cleaners located either near where he lives or even near where he works. The idea that he would need to rent a car every week is sickening. This is espcially true when there are some Cleaners that will pick up and deliver your cleaning for you. If this guy gets awarded all that money, I'm going to be really disappointed. We make laws like this to protect people from getting seriously hurt by bad business, not inconveninced.

That has to be the most ridiculous, money hungry thing I have ever heard of. I can't believe anyone would even entertain suing over a pair of pants and the amount is what makes it so much worse. Stuff like that really makes us all look trashy and the fact that it's a judge makes it even worse. I feel really bad for the cleaners. I am sure they didn't do it on purpose. And they tried to settle for enormous amounts. Way more than the judge deserved. Why can't people just be nice anymore? :(

I dont think that this lawyer has only one pants and he missed all his sessions because the laundry shop lost his only pair! thats stupid! And besides is there something or some law that can protect ordinary people from this kinds of crazy lawyers?!

we will all be hoping that this case will get thrown out. it is illogical and so unfair. it is crazy for that guy to charge his daily dry cleaning expenses to the chung family, just because from that day on, he refuses to patronize the service that the family offers in this field of service they are offering to the people. it is really crazy for him to have filed a case like this in court in the first place.

I thinks that Judge sueing over those pants is crazy. How could something that dumb even be processed threw the court system. What this guy will end up doing is having this dry cleaners go out of business from all the legal fees. That just shows how wonderful and great our court system is....only in America...

OMG, I had not heard about this (no, I don't live in a cave, it has just been very busy around here lately!) and I find it appalling! I cannot believe that an educated member of the judicial system would waste valuable court time with such a frivolous suit. What a gold-digging excuse of a human being he seems to be. Let see, he got his pants, he was offered 6 times what they were worth but he is still unhappy. Geeze. If this is how his twisted mind works, God-forbid that I ever get in trouble while in WAshington, DC and have to sit before him for sentencing.

Let's just hope that people remember his name come election time and vote him out as a judge. He is a pitiful excuse for a human being, much less a judge. Isn't it amazing that laws prohibit people from suing a doctor for malpractice for no more than $250,000(I am sure I heard about this law and think I am right about it), yet this imbecile can bring a lawsuit for $65,000,000 for a stinking missing pair of pants!!! He should be dry cleaned!!! PEACE

Thanks for providing us with that excellent comparison. Our health and welfare is only worth $250,000 in the eyes of the law, but in this case a pair of pants could possibly fetch $65,000,00. It goes to show you how screwed up our legal system is. The Medical Lobby and the Republicans wanted a $250,000 cap on malpractice suits and they got their wish. And we the America people got screwed. Lloyd

This guy is a disgrace to the justice system. And he should be sued too for over using his powers.
