Frustration

Naw, this discussion has nothing to do with Irish... So, in selling the house that I was sharing with my ex, we had a rent back agreement with the buyers. This was because my new house wasn't going to close until at least a week later. When their property inspection came in, it mentioned pet stains on the carpets. I was really expecting them to come back and ask to have it cleaned, or ask for a carpet allowance (money toward them buying a new carpet), but they didn't. Then, very shortly before the close, they sent over an addendum detailing the rental. I didn't particularly like it, but I didn't try to negotiate it either. Not sure if I could have at that point, but anyway I signed it. They wanted a large deposit, rent based on their mortgage, and the house and carpet to be professionally cleaned. So anyway, I took care of the cleaning, R took care of the carpets. I had cleaners come in and do 6 hours of work on the kitchen, bathrooms and floors (other than carpet). They did an awesome job. I did not ask for them to do walls, windows or inside cabinets. For one thing, there wasn't time, and for another, the contract didn't specify those things. R, on the other hand, chose to clean the carpets himself. With the exception of the family room, which had a lot of traffic, he left those carpets pretty immaculate. He didn't have time to give the family room his best job though. 12 days later, on a Sunday, our agent calls and says they are claiming the house wasn't clean, and they want receipts. The walls aren't clean, the carpets aren't clean, bla bla bla. Well naturally I didn't get a darn receipt. And, strangely, the cleaners are not responding to calls or e-mails. Not sure if they are just really busy, or are on vacation this week. But the contract didn't say walls, so I will get a receipt for "professional cleaning", which is what the contract said. As for the carpets, they can deduct a reasonable amount (probably around $250 - $300 based on the estimates I am getting) for the carpets. That is way overkill since only one room needed to be done, but I am fine with that just to be rid of these jerks. It's just frustrating me half to death that the cleaners were so responsive when I called the first time, and now I can't get hold of them on any of their 2 phone numbers or 2 e-mail addresses. They are a very reputable, award winning firm too, which is why I suspect they are on vacation. Well, the buyer got 12 days to raise issues, I get 12 days to turn up a receipt, that is how I look at it. But, frustrating... Cost me some insomnia last night being annoyed about it.

If it's not about Irish, why is it in her category? We need her back, is this a ploy to get her back? and those buyers are jackasses, obviously they or their "rep" didn't even take a good look at the job that was done.

It's a sneaky way to say I miss her. Dunno if their rep looked or not, but I hope they didn't take photos, because if they don't get reasonable, I will take it to arbitration.

Woudln't the photos still only show one room? though I suppose they'd concentrate on that one "highly trafficked" room anyway....

Well that's my point. They can't prove that the carpets were dirty anywhere else, because they weren't.

Richard did the carpet cleaning. But if the buyer paid a carpet cleaner, they had better be able to produce a receipt before they deduce anything.

OUr frustration was the bank took the house put up for auction then someone bought that day we were still tring to get the loan fixed and inspectors we could hav e done without they were the pain as we had to re fix the place so we could live in it thats why the low price we paid. Then when it did kick in we had 7 days to get moved and fixed up for CHristmas! SO I do know how you feel

BOy, I haven't seen that category in many a moon! My rug cleaners are hard to reach too. Usually calling back in the evenings. Atleast you have two numbers AND two emails. I only had the numbers. They work as a family and have no secretary or anything. But the price is worth it and they do alot of extras. And you do have 12 days. I would certainly consider this inconvenience when you need another cleaning. Good luck in getting ahold of them.

It's a family business, and I suspect they took a vacation this week. I will find out on Monday. But I"m doing some reading on landlord tenant law in California, and I don't believe they can require us to professionally clean the house.

I have to get my rugs cleaned this next month and I know how expensive it is. We just do traffic areas, living room, stairs, and hallway but it costs. Luckily my guy will let me pay two payments so it doesn't all have to come out of one months SS. That helps. I hope it turns out in your favor.

I too get worked up on issues, even after most of my problems are resolved. May be it is the women thing..to go through insomnia. :) Out here, we can easily get it from others by bribing..lol We live in one of the most corrupt parts of the world, meticulously designed to ensure that people dont suffer with insomnia for nothing. The cost is just a nominal ammount..5 dollar bill? lol

Hi there Dawn I know all about what you are experiencing; major frustration. I bought a house three years ago and decided to build an addition to the house. I got all the right people except for one thing; the water that was coming in through the wall and rendering everything to be damp and moldy. For 3 years I am after the guy. Finally I just acceded and this very weekend when I got some royalties for my new book I was able to pay for it. Then it rained. Last night I thought the hard rain was going to break my windows. Now it's for next week.

Hey dawny...in 6 hours, if the cleanerS did not do windows, walls or inside cabinets or carpets...what the heck DID they do??? Is it possible the buyers and the cleaners are in cahoots to rip you off and split the proceeds? Just my paranoia speaking.

Keep in mind that it's a large house that hasn't had a deep cleaning in a while. They did the kitchen (floors, counters, sink, appliances, fronts of cabinets), bathrooms (floors, counters, sinks, tubs, showers, mirrors, fronts of cabinets) and the hard floors in the rest of the house. The kitchen was very greasy and the bathrooms (esp the showers) had a lot of built up soap scum and such. They did a really nice job. Anyway, the buyers have no idea who the cleaners were.

Hi Dawnald, That is terrible. Why did the buyer wait so long to let you know they were unhappy with the cleaning? They should have let you know that immediately. I hope the sale of your house doesn't fall through. I wish you all the best. Please keep us posted.

The house is sold. That's not the issue at all. Getting our rental deposit back, because we rented it for a month after we sold it, is the issue.

I never have beought a house much less sold a house. I have lived in only 4 places in my life. I am happy I never have had to deal with crap like this! Probaly never will! Owning a house has never been or will be in my plans. I will stay with renting,thank you very much!

Oh gosh, who'd ever think all that would come up! I would be pretty frustrated too - argh! I hope you get the receipts that you need, which I wouldn't think would be a problem once you got a hold of them . . . maybe the cleaners are out for the weekend or don't pick up the phones or reply on weekends (so hopefully you will hear from them Monday). How did R take care of the carpets? Are there receipts on the stuff that he used - for cleaning solutions or if he rented one of those rug cleaning machines? We had other lame frustrations before escrow closed - different frustration, but irritating . . . I hear ya on the insomnia!!!!!!!!

Did a little research on CA landlord tenant law. Landlord has to return the security deposit, an itemization of deductions, and copies of receipts if deductions exceeded $126 within 21 calendar days. The California Supreme Court ruled that if a landlord does not comply they must forfeit the entire deposit. We are now on day 23. Yesterday I wrote them a letter asking them to return the deposit. We shall see what happens.

My response would be towards cleaners... I clean the carpets once a year, and it's about that time of the year again. I am just amazed how persistent some of this cleaners when you first call them. I initially emailed 3 companies to get an estimate. I couldn't believe how many phone calls I got afterwards wanting me to schedule the cleaning already. I'm sure it'll be just like you said after they do the job. If ever I would have a a question or a complaint, they would be on vacation not answering emails and phone calls.

I e-mailed one for an estimate too. They didn't want to do one unless they came out and looked, but I talked them into it. And then, yes they did try to schedule an appointment. I ended up telling them that I was on a budget and comparing estimates and that I would get back to them.

Hi when people become Land lords like in USA Most are crooked When I rent a apt I take photos Before I move in and photos When I move out today to Get rent deposit back Most of the time you have to Take the landlord to court To get your deposit back they do not care about state or federal law Some place I look at are not even Clean they expect the next tenant to Clean the apartment and even the town law said the owner has to clean and paint the apartment for the next person I know your is kind of different since You were the owner of the house before You became the renter try to talking to the lawyer who help you close the home Today most people are greedy have a great day

Now there no point of whining, the world is full of cheats so its best when things are kept in ones hand first. Call it renter or the cleaners you need to be clear with terms and act accordingly. Don't take anything for granted.

This is where a realtor earns their commission. If you had one of those they would have taken care of all of this. I was in the lending business for 35 years and I can't tell you how many sales fell through or caused terrible upset for either the sellers or the buyers over small issues such as these. On the whole sales that went through a real estate office were much easier on everyone. I bet you never pay for a service from anyone without a receipt. Lesson learned. Hope it's all resolved now. I am not happy that she just sent the form and didn't go over it with us. She did that will all of the previous forms. I would have liked her to tell us whether we had room to negotiate on it or not.
