More Red Tape...Not In A Good Mood

I'm so discouraged right now beyond belief. Some months ago I related the red tape I was going through about trying to get an IRS Treasury Refund check deposited into my account. It was a refund actually for my mother, who is deceased, but since I'm her personal representative was entitled to. So when I got the check back in April, my bank refused to let me deposit it as it had not only my name on it but my mother's name. I had gone through a similar hassle last year with another similar check, but after getting in contact with a Tax Advocate indicated that I did NOT need Letters of Administration or court appointment to get that check deposited into my account (my mother didn't have any bank accounts at all). After much consternation, when I went back to the bank and presented the letter the Tax Advocate sent me to indicate that as long as my name was on the first line of the check, my bank had to honor it..I was able to finally deposit it.
Well not so this time. I got this other check back in April of this year and now my bank was adamantly refusing to let me deposit this new check --they wouldn't even honor that Tax Advocate Letter of last year.. So don't ask all the people I was getting in contact to somehow manage to get the check deposited into my account.
I had gotten in contact with a new Tax Advocate and was instructed to send the check back to them and they were going to arrange getting the check issued only in my name rather than the way it was, with both my name and my mother's....so this was back in April 23..all this time I've been patiently waiting. In the meantime, my ditz bank sent me an affidavit that I could get filled out in the presence of the bank manager allowing me to deposit the check...problem? Well I no longer had the check. I sent a letter to my main branch of my bank informing them of this fact. I also asked, why didn't they provide me an affidavit when I HAD the check?
So then I sent another letter to my bank about what was going on, and that I no longer had the check in question, so then my bank sent a letter back saying that the affidavit would only be good for that specific check...they said if the check was reissued only in my name no problem...but the affidavit was only good for that check (that I no longer had). I got a call from the Tax Advocate on Monday telling me the new check had been mailed out and should be getting it soon and to call her the moment I got it to tell the Congressional Office that the case had been handled...oh yup got in contact with my Congressman.
So my mail comes late in the afternoon...went down today and the check was there...BIG PROBLEM...it was issued exactly the same way! Instead of just being in my name, it had my mother's name on it again...I called the Tax Advocate right away to let her know...guess what? The jerk is now on vacation and won't be back until July 28th!
I'm going to try my luck Monday with my bank and the new check, but I doubt I'll be able to deposit it and will go through the same hassle all over again..it took me three months just to get this new check and it was issued wrong again!....Like I said I'm so discouraged not to mention depressed and am sitting here like a zombie not in the mood to do anything....I'm really not given to moodiness, but I'm sure moody as hell right now. I've cranked out a few letters including another one to my Congressman to give an update about this, plus the Comptroller of the Currency, my bank, and so forth. Like I said I'll try my luck on Monday with my bank, but I'm not very encouraged about it. So send some prayers my way that maybe I actually can deposit this check on Monday.
Okay to turn this into a discussion...Have you ever hoped for a final settlement on something that was taking a long time and in your favor, only to have another setback again?

I am so sorry that you are having to go through this. I have had to deal with things like this all of my life. I cannot believe that something so simple has to be so very hard for some of alot of times. Even when we should not have to go through heck and back, it never fails or ceases to amaze me when it keeps happening. I hope you get it all worked out soon.

I think a lot of places put us through the ringer hoping maybe we'll fade away and give up and not bother them anymore...well I don't give up easily..LOL

Pye's Mommy..I'm so sorry you have had to go through this..if it wasn't such a mess and knowing what you've been through i would have thought you were making this up just to confuse us like its a marx brothers show..Funny that you have had so much of a run around just trying to do whats right and owed you, but the Tax people still are in Lala Land..wonder who works there? Monkeys??

I think the worse offender is all the crap I'm going through with my bank...I've been a customer there for about twenty years...like doesn't that count for anything?

I think one of the reasons it took so long to even get that new check was that it was sitting on that Tax advocate's desk for a long time. I had mailed everything back to her on April 21...since I sent it Certified/Priority Mail I was able to track it...she got it April 23rd..called the next day to verify she got it and she told me. "Oh, I haven't looked at my mail yet." Huh?

I cannot believe you are still having problems getting your money pye. What the heck is going on over there. It is not like you are from another country. Why didn't you just sign your mothers name on the check in the first place and be done with it. I guess if you would have done that you would have been put in jail for forging a check. Gosh next it will be your social security telling you something about that little bit of money you are getting. What a bummer.I hope the bank lets you cash it on Monday I will keep my fingers crossed.

Hi pyewacket! Oh goodness! I don't think I would have that much patience for all those people. Goodness, if they are just their minds they can just call and verify, it is just a check and besides you have a record already in that bank and have made transactions with them before. Aarggh! I do experience similar situations like that but when I am fired up, I wouldn't stop until I get real answers and I really don't like waiting unless I don't have any choice either. Sad! Praying and hoping that you can have that check deposited on Monday.

all the time, right now I am jumping through hoops trying to get my disability,
they are cancelling the temporary disability as of Nov lst, and I have to try for permanent which is 100 times harder to get.
So I have been scheduling a lot of medical appointments

Oh good grief! They are really dragging this one out for you aren't they? Someone at that bank has their head buried somewhere where it shouldn't be (maybe it should?). I am sending lots of positive thoughts and prayers your way hon. I really hope they can work this out...you'd think SOMEONE would be able to! I haven't had to deal with anything like this. I think if I were in your shoes, my crankiness would have spilled over onto those people AGES ago.

You probably would not have those problems in Australia.
Like I was saying in another question of yours... everything is done electronically via computer in Australia.
You pay your taxes electronically and get your refunds the same way. No check.
People pay everything the same way... rent, electricity, phone, broadband... etc..

Yeah, that sounds like the government. It also sounds like a bank. It also sounds mighty depressing and irritating. I would have given myself a migraine if I had gone through all of this. I remember trying to fight for some money SSI had taken away, contacted my congressman, been assured it would be taken care of. And all they ended up sending me was a letter they had received when they had contacted SSI to inquire about it. Like sending me that letter was anything? I already knew what they had done and why, that was why I contacted the congressman's office. I sure hope these dopes can get their act together for your sanity and health's sake.

Well if I get no satisfaction on Monday at the bank, I have a detailed letter all typed up and ready to droop off in a a mailbox to my Congressman...maybe a representative there can shake them up a bit, just like that woman who helped me when I went through my SSI problem

I went through so much when I injured my back(original injury) at work
That time I was off work for over 2 years and bed ridden for over a year.
They kept wanting me to go to doctors that were hours ride away from me
when I could only be moved by ambulance...Do you know what that costs?
I am so sorry for what is happening..I know how frustrating it is!

Oh yup--I know what ambulance costs are. During the last year or so of her life my mother was having to go to the ER on a regular basis...think each ambulance ride was about a hundred dollars...the real kicker? The hospital is only two blocks away

Wow, what a pain! You would think that banks have seen checks like that before, where they're issued to someone who is deceased and an executor of their estate. I would think that any documentation appointing you the executor would be good enough for most banks.
I'm notoriously impatient, so there have been plenty of things I've wanted to be finally settled, but if they take more than a day or two, I'm already thinking how LONG it's taking. :) So I'm not a good judge of that. Mostly, the only way I can get through a process that takes a long time is to just forget about it, which is probably not a good way to get things done. :)

Well all I can say this has been the longest three months to get this resolved...I've done an update of what happened today when I went to the bank....it's VERY good news...LOL..I was able to deposit the check...yipeeeeee

havent got your check. I would be steamed too if that had
happened to me. I had one hassle not as bad as yours but
infuriating to me. I deposited a hundred dollar bill in the a tm machine at chistmas time to my account it was a christmas gift.some idiot in the bank only entered ten dollars in my account. now thats plain stupidity. I went into the bank and they sent me to a phone to call Phoenix, then I got a snippy woman who said do you really want to dispute the claim, Isaid I deposited a hundred dollar bill so yes I want to dispute it yes,so she says I have to send you to claims, so she sent me to claims, where an intelligent personable man told me he had to send me a form and I had to fill it out then mail it back and they would go from there, he could not do it, it had to be on the form, so I said mail me the form then as I did not know what else to do. then I got to thinking why could not he do that there without the form and weeks of waiting so I called the same number again and this time I got a woman who did know the protocol. she took all my info and my bank id and all that stuff and put it into the computer and told me it would be about three or four working days and the money should be replaced. so after all she could do it and four days later the missing 90 dollars was added to my account.I just had to get the right person evidently. lol lol

You know it really does boil down whom one is dealing with and has the knowledge to get things done...so far, it seems none of the people I'm dealing with know their a$$ from their elbow. Glad you got your problem resolved though. I know eventually I'll get mine resolved too, but seems the waiting is forever.

What a mess, don't anyone know what they are doing? it would have driven me mad, no nothing like that ever happeded to me because my husband handles everything for me thes days and he won't stand no nonsense with anyone. Apparently they don't know what they're doing...it's like they all have sawdust for brains. Thanks...I need some prayers here that this can be resolved....soon!
