Have you planned for the future?

When I say 'future' I mean way in the future hopefully.....What I am really asking is this....Do you have a will? We had our wills done about 13 years ago. Since that time things have changed considerably. Items we designated go to a particular person have been sold. People we left items to or who otherwise were part of our wills we have eliminated from our lives. Things changed and we knew it was time to have new wills drawn up. We asked our financial guy at the bank for a recommendation for an attorney and we met with said attorney a month ago. (They don't move fast around here.) Finally got a call yesterday that the wills are ready to be executed and we'll do that next week. I know, I know...some of you think: . I'm too young to have a will, or . I don't have anything to leave to anyone Think again - death knows no age and if you think hard enough you will realize you do own things. Things that if not called out in a will would most likely go to the State in which you live. It takes a little thought but if you meet with an attorney he will walk you through the process. We knew what details we wanted included in our wills and the attorney did bring up a few things we had not thought of. We don't find it morbid or weird talking about our wills, death is a part of life. My husband and I both feel better and more at ease knowing our wills are in place.

Yes, we have signed our Will in front of our Notary and two witness. The Will is deposited at his office, so nobody can say that it's a "fake" will.

@AbbyGreenhill In Europe if you want to be sure, you have to go through a Notary, it's the only way to go.

@LadyDuck Here you use attorney or in TN you can write your own will and have signatures notarized. I don't take chances I use the 'law'....

In TN they don't enter the wills in the court like we did in New Jersey. So it's up to each person to make sure they are safe. The last time they gave us the wills, we had the only copies, I assume it will be the same this time, but it is a different county so who knows.

No, I don't find it morbid or weird either. Good sense actually. I wrote a note that I have in my USB device and it has instructions for my daughter. Then I also have a Living Will which I think is important in close families.

@AbbyGreenhill ....That sounds like a plan. I just didn't want my daughter to feel badly. I know she will be upset and I don't want her to feel badly if I am sick and they can't revive me.

Thanks...... Considering it's just the two of us we opted not to do a living will. My husband knows my wishes and I know his. After one of us is gone the other should do a living will.

@Drosophila The odds are you will outlive your parents so people normally leave the money/things to some younger people.

We updated our wills two years ago. After dealing with my mother's estate we went through and organized our finances as well. I don't want to leave a mess for my kids. My mother had money and property stashed all over the place. It's been a year and a half and we're still trying to untangle the mess.

Is it mandatory to have an attorney for a will in your country ? Here you can write it yourself and keep it at home if you want. As I live alone since a few years now, I deposited mine last year in a notary office and there is a record in a national database of wills.

Some states allow you to write your own will - the state I live in is one of them. But I don't want to take the chance of something strange happening and someone contesting the will...we used an attorney. I am not sure what other states allow you to do your own.

No, we talk about it, then do not do them. Since we have many small children it is my fear that they will not go where I want them to should something unforeseen happen. I really need to get one done

It's good to be prepared. I do have life insurance through my job and I should probably get a will drawn up at some point. Not having any children, there's less for me to worry about. When I do get a will I'll probably use Legalzoom and do it myself.

@Jessicalynnt We can do our own wills here in TN, but we opted for an attorney. If your state allows you do to you own then you can, but having worked for lawyers and doing wills, I wouldn't recommend it. There are people we are excluding and we wanted to make sure those people can't contest the will and I wanted all the T's crossed, etc. With that being said, our wills are probably more complex than yours would be. You can always check out legalzoom, although I hate the thoughts of that man getting more money.

@AbbyGreenhill is this better to do with a lawyer, and not oneself?
17 Sep 16
we do not, though i know we should. we don't really "own" anything, but you know, there is STUFF. we are just so in debt that i can't even think about the future... sigh. but... it seems nowadays you can just do your own will with software & have it notarized.

@Ayuriny It is a good idea to have a will. If not, and you die, your money will go to the government instead of your family etc.
