Man convicted of rape for removing condom during sex?

I know sex is a dicey proposition in the late post-modern era, or whatever era this is, but this headline caught me by surprise!
Apparently it was a French man who met a Swiss woman on-line. They wound up making whoopie (no details about the relationship were in the article I read) and during the act of whoopie the condom wound up in the sheets somewhere.
There must have been evidence that the man knowingly removed the thing, as he was convicted of rape in a Swiss court and given a 12-month suspended sentence.
Given that ignorance of the law is no excuse, and that some see thoughts as just as sinful as behaviors, I'm wondering if I won't wind up back in jail again soon. Am I a prevert and don't know it? Or just an insensitive beast?

um, those things dont always stay where they are supposed too, wonder how they know it was intentional, and really, rape? That's a big deal, and makes it dicey to have hookups!

I don't know about you, but it's quite odd that she was able to pin that on him just because of that. Sounds to me like it was consensual with adults.
A different, odd arrest happened recently in Michigan. A man had went outside and started his car so it could warm up before leaving for work and was given a ticket for doing so. I guess it was on Fox news and my husband informed us about this oddity.

@TheHorse It sounds like it was only that he warmed up his car in his own driveway. I wonder whether they'd been keeping an eye on him and got him for something else too, but the report never mentioned anything else.

Rape is the wrong charge. Not sure what the proper charge should be. He shouldn't have to live his life as a convicted rapist. Maybe deceiving jerk
