My sentence reduced.

I have been here at this correctional facility for almost five years now and the government is holding me back from applying for a new trial.I had an attorney who was willing to defend me pro bono but when he began to file the papers things began to happen at home.One is my house was broken into and ransacked.My then wife had said nothing was taken,yet when police were doing the investigation they found a large amount of money and weapons.They charged my wife and also added new charges to me.The police department scared my wife so bad that she lied and and said that it all belonged to me.She then informed me she was going to divorce me.I have no idea where this money had come from,if i had had any money I would have hired a lawyer to defend me.I'm here for a hold up that I had nothing to do with,the police are trying everything in their power to get me to tell them where the money is.I have tried to get help from different lawyers and they seem to believe i have the money too.I need to find a way to get a new trial or at least get my sentence reduced.If there is a way for me to do this on my own,maybe I will get a fair deal.

I really dont have any legal experience but just read your post and wanted to let you know you will be in our families prayers. I think everyone honestly deserves a fair trial and if you didnt recieve that then I hope you get your statements heard again. It has to be tough to be there and not be able to know whats happening at home and not get to voice your oppinions. If you got new charges added wouldnt this entitle you to be heard again? Not sure since I have no knowlegde of the law.

Prisoner what I would like to know is where (what state) are you incarcerated in ? This is one place I never want to move too. I don't see how a person who hasn't been out in 5 years can have more charges added to them when they haven't been around to do the crime. Unless maybe there is more to the story than you have actually put on here. Sometimes it is hard for us to see everything unless we can see the whole thing.

He wouldn't have to be there for the weapons charges to be filed against him. In many states, being in possession of an unregister weapon...or an automatic weapon...is a crime so, if his wife claimed that weapons found in his home belonged to him, he could be charged.

It only goes to show the imperfections in the justice system. I wonder how many people are incarcerated because of improper representation of lawyers. How many are jailed because they don't have enough money to hire good lawyers? The innocent suffer while the guilty go scotfree. How I wish I can do something. For whatever its worth. Don't lose hope my friend. I pray that your case will be reopened and truth will come out. That's unfair. cheers!

I knew someone that was incarcerated for years and held fast that they didn't do the crime. It was a hold up too. What kind of evidence did they have against you to convict you? Most of those pro bono lawyers are just taking the case because in some states laywers are required to take a certain amount of cases to keep their license. Doesn't mean they have to win them though. Did the state appoint you one or did you find one yourself that was pro bono? How long have you been sentanced for?

Like most others who have responded to your mail, I too am no legal person, but something tells me there is more to it than what meets the eye. You have been in detention for 5 years and during these years nothing happened until you filed for a new trial. Whatever happened at home must have been the work of someone who knew that you were trying to come out. Had you come out, it would have caused considerable damage to their privacy or freedom. How could the cops not trace the money to you when you were in the correctional facility for 5 years? And how come some money and a weapon appear all of a sudden? My guess is that whoever ransacked your house planted the stuff there to implicate you and keep you there for good. I suggest you try to come out on parole, if possible, meet a detective agency and have them investigate this case. I'm sure that they are good enough to get to the bottom of this. OMG that is terrible! Who did you pissoff? Had to have pissedoff someone for them to go to the trouble of setting you up then messing with your wife like that. I'm surprised they are allowing you internet privileges to be honest. Someone might be inclined to believe you and try to help you out. Unfortunately, it will be at least 10 more years before I get my law degree..a long story you don't have time for. So this lawyer that is up for a pro bono case is no longer willing to help? If he/she believed you to begin with, what happened? Seriously, this sh|t is going on everywhere and if ppl don't stand up for ppl like you, it'll be one of us next. Details, please.

Like you I will admit our justice system stinks. I know you have heard "a person is considered innocent until proven guilty" when in truth you are considered guilty of the crime until you have enough money to pay someone to prove your innocent. There is no such thing as a fair trial, the judicial system(judges, attorneys and police) are as crooked as an S. Many who have had the money but were guilty (think O.J.)have been released back onto the streets and laugh at those who tried to do the right thing. Until you can get an honest criminal Attorney to believe you and see the case as one that will get them much publicity you can only pray that someone, someday will step up and confess or some lawyer takes up your appeal case and does the work your first attorney did not. What I don't understand is what did the B and E at your home have to do with your lawyer? This was no cause for him to stop your defense. Was he a court appointed lawyer who had to do a quota of pro bono cases or was he doing it on his own? He is obligated to let you know why he isn't pursuing your case. Go to the facilities library and study any and all law books they have, You may be able to help yourself or find a way to get someone in the courts to file an appeal. I wish you much luck.

prisoner 101 if what you are telling us is true there must be a way for you to get a decent lawyer, maybe one who will take your case pro bono.We here at mylot have no way of knowing if you are telling the truth or a whole fabric of lies, but Iwill send my prayers to you to find a lawyer who willhelp you.do you have any other family that could help you with legal defense,or some trusted friends who could get you legal aid? I must admit that your story seems a little stretched out, I mean who is there out there that wants to hurt you so bad they would put money and weapons out there for the police to find? I cannot think of the man's name but on that television program America's most wanted is a man who might help you if you are telling all the truth. find out who that man is and get your story to him. he might be the key you need.

Hey friend, this is quite a powerful discussion! I have never communicated with someone in prison and it's great that you have Internet access and so forth. I'm sorry to hear about your situation, it must be tremendously difficult for you. Is there anyone incarcerated at your facility that does legal research? If so, I would ask them these questions. There should be some sort of court appointed lawyer you can get (for free) through legal aid. Don't give up - keep trying.

Hi prisoner Im no attorney either but I have been around the court system alot here in the last year or so. I can give you some suggestions to what might help you out. The first would be that you can file your own motion to have the case looked at again. The time you have spent is it sentenced time? If it is then you get request parole after you have spent 20 percent of your time. Then there is also shock probation. I don't know what else to tell you but will be more and happy to help. Hello prisoner101, I am really sorry - I am also not a lawyer, and am not aware of any such procedures. I doubt if I can really help even if I tried to read thru in the net. But I believe u r innocent. I hope god helps u to come out of it. Take care. Have faith, miracles do happen.
