wife of the father of your son would not let you claim child support

please help, i have a son out of wedlock and his father gives support when we parted however when he got married his wife insists that i should not claim any child support. does anyone has the same prob? please share what to do

Do you have custody of the child? If so, the father has to pay regardless of whether or not you married. As for claiming it...that is your right.

sorry for the late reply, thanks for the advise but i believe his father does not care anymore. even worst banning my son to see his grandparents is so much painful on my son's part, coz he enjoyed being with his grandfather =(

I am so sorry. It is sad what some parents will do to their kids and not seem to realize or care about the pain they cause them.

I don't know how things work with child support where you live, but here in the US he would have no choice but to be ordered to pay and his wife would have no say in the matter. I would try to find some inexpensive legal representation and find out what your options are. Your son should not be punished just because his father got married to another woman.

Well I guess you can go to courts to claim it. I think you have all the rights to claim for it since it is his son that you're talking about in this case. It is the obligation of the father to give financial support for this kind of a person. I guess your only option is through legal means since the wife is not amenable to such kind of arrangement anymore.

It is not abnormal for a mans new wife to request such a thing. But the thing is he is just as responsible for that child as you are. If you can't get him to pay then take him to court. You can usually find a lawyer who handles stuff like that for free. I dont remember how but you can get a lawyer who will take it to civil court i believe and it will come directly out of his paycheck. Also he may not even be paying you what he should be. The court bases child support on their income. GOOD LUCK.

I don't have that problem...but if the man's name is on that birth certificate then she has no right to say what does and does not belong to that child. She's selfish and greedy if she thinks that. ~Pleiades
