Supreme Court "evading the issue?"

You are the second person here on MyLot that has fallen for this story. Clarence Thomas is speaking to Subcommittee Chairman Rep. Jose Serrano, D-N.Y. Serrano asks Thomas "I'm still waiting for the [court decision] on whether or not a Puerto Rican can run for president of the United States." Thomas evaded that question. Puerto Rico is apart of the USA but has the status of a commonwealth. There is no reason for the court to decide on a subject that has never come up.

They are evading the issue because there hasn't been a case brought to them that has any merit. A case was brought to them after the election, and all of the conservatives on the bench DECLINED to proceed. It wasn't even a party line vote either. Thomas himself said that there wasn't merit there.

We are evading that issue was a joke. You even pointed out the joke. I believe that this was just banter between the two men. They really are not evading the issue. There is a case scheduled June 29th. They will not be able to evade it then.

I would imagine the question that needs to be regarded is whether or not one born in a territory of the U.S., possibly to American parents, is eligible to run for the president. For example, it was decided last election that even though McCain was born in Panama, because it was on an army base to two Americans, he was eligible to be elected.

I'd guess they ARE doing their jobs and so far that question hasn't come before them. I think Supreme Court Justices in general are good at evading questions about something they may at some point have to actually rule on.

Far as if Ann Durham and Barack Obama Sr was married or not Obama Jr says his mother and father was married in his book "DREAMS FROM MY FATHER",so many of you believe every word Obama Jr has ever spoken why do you now say his parent's was not married,are you calling Obama Jr a liar?
How do you know that Obama Jr parents was married,you don't,how do you know they was not married? you don't.
Why do you not know,because there is no "RECORD" of their marriage at least in the United States.
How many married people in the United States do you know that has no marriage records,likely "NONE".
Barack Obama Sr was named on a Hawaii certification of live birth (COLB)as the father of Obama Jr.
In 1961 a child could had been born any where in the world and the parents of the child could be given a Hawaii (COLB),this in no way proves the child was born in Hawaii.
How many teenagers do you think that have named a man as the father of their baby only to find out he was not the father? this is one of the oldest tricks on the books .
In reality we do not know who Obama Jr's father may have been.
Dead people do not talk try to talk to a dead person see how much information you get out of them.
Obama Jr's white family that he says is his family was most all dead by the time Obama Jr came on the political scene.
There is scant pictures of Obama's Jr's white family,maybe two of him and who he claims is his mother Ann Durham and maybe at the most two of him and his white grand mother,dose three or four pictures seem rather very odd to you of a loving and devoted family?
I find it some what interesting a mother has her first born and there is one picture of that mother holding her baby in a picture,I noted no father or white grand parents in the picture,the next picture I see a fat little smiling boy about 8-9 year's old living in Indonesia.
I see Obama Jr off to him self no caring loving arm around him what so ever.
Just has struck me as being very odd to say the very least about Ann Durham and her mother being what Obama Jr has painted a a close loving devote family.
Obama Jr believe it or not is a mystery man and to date he has refused to make public any of his records....WHY? Oh I forgot because he can.
People can spin what Clarence Thomas said all they want but the fact remains Obama Jr has not yet proved he is an American citizen.
The birth father he claims to be his bio father Obama Sr was a British citizen,the women he says was his mother Ann Durham an American citizen.
Having two parents only one an American citizen the off spring may end up with divided loyalties,if that off spring runs for president of the United States they can not have divided loyalties and set in our oval office.
The case below will be heard on June 29,2010 at the third circuit court of appeals in New Jersey.
