I have a question that I need real answers too. My daughter's boyfriend has spina bifida and draws a disability check each month. He is currently working at Kroger where he works in the same department as his dad. Now disability is saying that they have overpaid him and that he owes 45,000 dollars to them in pay that they have overpaid him. Is it possible that they can make him pay that amount back? Is it possible for them to take his disability since he is in a wheelchair and has no use of legs

I honestly have no idea. I think that is awful for him though. The government sucks with their rules and stipulations. I thought you could earn so much money per month even if you are on disability?

Yes, he has reported his job. He has a paper filled out every year and each time he sents it in they say that he is entitled to a raise in his disability and now they are trying to say that it was a mistake and he has to pay it back.

My understanding is that depending on what percentage your disability is classed at you can only make up to a certain amount of money. If you make over that then you aren't suppose to collect that month. The few people that I know on it haven't been able to work more than 20 hours a month and still have benefits. That's my understanding. That seems like a lot to have to pay back. Is there penalties and interest added to that? If not then he must have been working for a good number of years, and collecting disability benefits. Wow that's a lot of money.

The 2 people that I know both said the same thing. If the earn more than approx $750 a month for 7 months or more in a 5 year period then they have to be reevaluated. Disability is for those that really can't work, but want to feel like they are contributing to society. I'm not saying that this person you know has done anything wrong knowingly, but the government sets up these rules to try and prevent abuse from happening. From what I understand this information is posted on the website. I would highly recommend for him to seek out a lawyer that specializes in ssd, and bring all of his award letters to show, and all proof that he supplied to ssd for the lawyer to take a look at. The government isn't usually very forgiving, even when they ate the ones that make the mistake. They eel that individuals should know the rules, regardless of how complex they can be. I just want to say that I mean no offense and am not judging your friend as I don't know all facts. I wish your friend much luck, as it sounds like in the near future he is really going to need the help of ssd. Under the current circumstances he most likely won't be eligible for benefits.

Yes, he has worked for several years because his dad helped him get the job. He is allowed to make a certain amount of money and he has not met that. He also has gotten a raise every year because they say that he doesn't make that much. Now they are saying that they goofed!

Yap! While it would not hesitate to take money from you, the government will take what belongs to it, regardless. If your daughter's friend is in a wheelchair and has been receiving such a large sum in disability and is suddenly sought after, then my guess is that he may have money somewhere or has come to a large sum of money and the government found out about the money. And this would be reason for requesting he pay back months of received payment. Owes $45,000? Is this in US dollars? I mean that would be months of payments. It took the government that long to catch up?

No nets, he has not gotten a large sum of money or anything. He has been working for several years and is allowed to work and make a certain amount of money. Each year, the governement has sent a letter stating that he has not made that much money and given him a raise. Now they are saying that they made a mistake and want the money back. There is no way that he could get another job in the same field if he was to lose this one. Plus, he currently needs to have a surgery that will take him off work for several months. What is he to do then?

I'm on disability, too. In answer,for every $2 you make, the government can take away $1 of your disability money, as long as you earn over $65. Although, personally, I think that $45,000 is excessive. I mean perhaps that's with penalties, but are they were trying to do that to me I will be calling a lawyer. It is also possible for someone to make more than what is permitted under disability, but even if that happens you can still buy into Medicaid. Good luck to him!

I think that the $45,000 is crazy as well and I think that he should fight it. He said that he could not find an attorney who would fight it for him, but I think that he is crazy. He needs the money and he is disabled so he should be getting some help.

forty-five thousand dollars? My brother, 60 IQ and works a few hours a week, they've overpaid him forty-five dollars before but not thousands of dollars. Usually they just deduct the 45 out of the next check they send. Like if he gets $600 a month, the next month he would get $555. It's usually because my brother made more that month than the months he usually works.

But that amount of money is ridiculous. Who makes that kind of $ at a grocery store? OR on disability for that matter? Did someone mess up a decimal or something?

They are saying that his disability ended four years ago when he began working and he owes the money that they have paid him ever since. Although, each year after his review they have given him a raise and paid him backpay for the year as well. How crazy is that?

Wow! That's unbelievable. He'd better get a lawyer. I hope he has documentation that they knew he had been working. Some lawyers will work for free. That's just awful. People don't make that much money on disability or at a store and you can make a certain amount working each month and still qualify for disability. Do you have an Independent Living Center (ILC) near you that might be able to help?

As sad as it is...I think they can. I know that for some of those benefits...they can work up to a certain amount but for disability..I don't think they are allowed to work and get the check. My ex draws a disability check and I know it is different depending on the type of disability they draw. There is a full support kind and a partial support kind. It is a shame that he is trying to work and all they want to do is make things rougher on him. A person just can't get ahead.

He is only allowed to make a certain amount of money and each year they send him a letter that says that he has not met that amount and then he gets a raise on his disability. It is sad because he feels like he should never have tried to do anything on his own and just let the government support him as they are punishing him for trying.

Wow!! I think personally some of this seems a little rediculous, and personally sounds like something a Lawyer might need to get involved with. But seriously unless he is working Full time there is no way that something like this could even begin to be right, and if so are they really going to not look at the Disability? Sounds like another reason to be worried about all the cuts they continue to do while helping out usually people who do not deserve the Help, or people not really needing it but offering it to them never catching onto the SCAMS. But anymore anything is possible, and hope something Good can come from this.

It is crazy!! I believe that he is getting scammed out of money that is rightfully his. I believe that his disability should be looked at because he could never get the same type of job with his disability. The only reason he is there is because his dad helped him to get the job and his dad is head of the department.

You can appeal. And I would definitely recommend contacting a local representative or a congressman from your state. Sometimes they really will help. SSI told me they overpaid me before, so they withheld some money for my checks for 3 months.

I told him to appeal it and I think that I will tell him to contact a local representative too. That might be a good idea. I could see if they were wanting a little back out of each check but they do not want to give him a check and they want that kind of money back.

As far as I know, there is a website you can go to for most of the questions and info you need on Social Security. I usually refer to www.socialsecurity.gov and just surf the site until you find your answer. Most social security rules is that you have to comply with their work rules. I cannot respond to your direct questions, but I hope this information can be of help to you. glowin100

I have given him the site and he is also going to fight for this.
