If your Christmas tree was seized...

This couple living in Cheltenham (UK) decorated nicely their natural Christmas tree, ending with an angel on the top, put it proudly near a window, and the police came, seized the tree, and arrested them "on suspicion of cannabis cultivation". WTF ? It is perhaps a cannabis plant, but what I see on the photo is undoubtedly a Christmas tree ! ...How would you plead your case to be acquitted ? The picture was twitted by the Gloucestershire police on December 22nd.
“Not your traditional Xmas Tree! Two arrested in Cheltenham on suspicion of cannabis cultivation.”

That's where I used to live That certainly is a weed plant so they'll be convicted without a doubt but will just get a fine.

There are also innocents living there : maybe they just bought it as a Christmas tree and did not knew that it could have another use ? If they have a good lawyer, the trial might be fun.

@Mike197602 I read that they have been bailed until February pending further investigation : maybe the police will find a Christmas tree traffic?

According to the police, it is. Yup, a good justice should reward creativity instead of sanctioning it.

@topffer Even when - or especially when - it's cannabis?

@JudyEv It was a general consideration. A judge can decide that there are exceptions.

It's so funny to me what the police will focus on sometimes . . . I can think of other serious situations they really could have attended to . And where was their spirit of Christmas? I wonder how that would work here . . . you know California has legalized it!

@topffer So I wonder who really gets on the Santa's naughtier list next year - the couple in possession of a plant(s) or the cops that took away their Christmas spirit? Let me tell you it's really strange seeing shops and billboards here promoting cannabis. If anyone who enjoys it sees this piece of news about a cannabis Christmas tree, that will surely give them some holiday decor ideas!

To respect the spirit of Christmas they should have waited the day after Christmas to seize the tree, but maybe they thought that it would be converted into smoke on Christmas night. If cannabis is legal in California, then you can certainly expose a cannabis Christmas tree near your window.

Many, many years ago, the boss of the company I worked for invited all his employees over to his house for a Christmas party. When we all arrived, we were quite amused that his Christmas tree was in fact a large cannabis plant that he had decorated for the holidays.

Lol, these English people were not the first to have this idea. Is cannabis legal in your state ?

@topffer It just recently became legalized for medical prescription only. It won't be long before it's legalized for recreational use.

I'm pretty sure they can get arrested for a Christmas tree, but those other plants sure look like cannabis to me.

Those other plants were part of the tree : the police mutilated it for their photo. It is unfair to seize a Christmas tree before Christmas.

@fishtiger58 Maybe they thought that they would smoke it all on Christmas day if they were waiting?

@topffer Oh they were part of the tree, how interesting. Well the police certainly thought the tree was evidence, so I would say yup they had to seize the tree.

Correction, Your Honor, they put a Christmas tree near the window, they did not knew that this one was not a pine tree.

Perhaps they shouldn't use so much of what they grow, and they'd know better than to put a decorated cannabis plant in their window.

The police do not tell if they found other plants than those in the Christmas tree. It is a bit weird to put it near a window.

Do they pretend that they thought it was a normal tree? It's a creative idea anyway.

I do not know what they pretend, but the police pretends that this tree is not legal. I hope that the justice will not sanction too much their creativity.

Good defense : they usually pick their Christmas tree in the countryside, and they found this original one by accident during a walk. I guess they risk only a ticket if they plead that.

The Christmas tree was made with cannabis plants, but maybe they did not knew what was cannabis when they bought the tree?

I don't recognize the plant so I can't tell. Perhaps the owners didn't know? Very strange happenings.

If they had known the plant, they would perhaps not have put it near a window ? Not sure.
