I Read the Contract Again

I think I'll be able to cancel the contract with my publisher soon. VIII: MANDATED PUBLICATION: a. WD agrees to publish and commence distribution of the Work within twelve (12) months of acceptance of the manuscript. In the event WD fails to publish and distribute the Work, upon receipt of a certified letter from the author, WD has six (6) months to publish the Work. If WD still does not publish the Work, the contract shall be cancelled. However, if events arise and WD is prevented from publishing the Work beyond their control, this timeframe shall be extended to a timeframe that WD and Author agree to. They accepted the manuscript on September 11, last year. b. WD will manage and provide guidance on the Work as follows: WD will instruct the author during the book production process of what is required by the author, giving the author deadlines when required. WD will review the manuscript, cover design, interior design layout, and any ancillary materials pertaining to the Work for typos, errors, or issues during the entire process of book production. WD will advise Author on any questions or requirements during the book production process. They have not done that. I haven't heard from my publisher about the book since I turned it in to her the end of May. By now according to the contract, I should have had the cover design, and it should be ready to publish. I've sent her two e-mails and the only thing I get from her is that she's working on it. She also told me she fired the illustrator. September 11 is in the very near future. I think I can easily cancel this contract. It does state that she can extend it for six months, but I would need to agree to it. With the lack of communication, I won't agree to that six-month extension. I am now looking forward to taking this book project back and publishing it myself. Have you dealt with someone who didn't live up to the terms of their contract? Thanks for reading.

hope that "beyond their control" part don't trip ya, hon. do ya got a legal aide office that'd make certain 'f such 'fore ya go'n cancel? 'twas 'bout 20 yrs 'go, i'd a similar jam with a publisher. i wish ya the best 'f luck.

I think I would cancel it and either get another publisher, or get it publish myself. I haven't had that before.

It happens. It's a shame it happened in this case since actual publishers can more easily sell books than going the self publishing route for a variety of reasons. But glad you can put the project in your own control again.

Before the 11th of next month talk to someone in Legal Aid and see if there are those in your Writers Guide that have dealt with similar problems to see if they an advise the best way to go and proceed from there, insstead of eing strung aong

Never had to deal with that before. Glad you got it straight and will do it yourself. But I have had friends who self published as well, with no problems.

I'm planning to go back to self-publishing. It's the best way for me. Now, all I need to do is learn to market.
