I got good news, you guys know the pressure I have been under about moving and afraid that I would be on the street on the lst of july,
then the landlord said he couldn't leave because I told I couldn't find a place, and therefore my lease had to continue,
but he wanted 100 dollars more a month and I said I could not pay that which I couldn't and so we were under so much stress, that I was literally too ill even to stay up during the day,
he said he would think about lowering the amount he wanted, but he never got back to me,
well tonight he did come back with an offer instead of 100 dollars more it was gonna 30 dollars more and I said that was too much. And so he said okay for this year he will leave the rent the same as it is and he will fix the back yard I am so amazed and happy.
Next year he said to be prepared for the big raise since he is not going to do any repairs this year it will be all done next year.
I will worry about next year when next year comes, but for now I am happy.
Finally after three full months of stress I can relax again.

41. bdugas (2472) | 6 months ago | So happy to hear that you are finally getting things straight, I know our landlord just up our rent from $555.00 to 576.00 this might mot sound like a lot to some, but for people on a fixed income it is a lot. My hubby got a $40. raise on his Social Security check on the first of the year and our rent has gone up from $20. to $220. now I am getting $257. a month in Social Security and I had to go over there yesterday and turn the paper work in and I am scared to death what that will do to our rent. We are also on a level billing on the electric, and I know it will go up about $50. while the increase in pay will lower our food stamps to around $80. do you know any one that can feed 2 people on $80. a month.So after all these years of waiting to draw my Social Security all it has done for us is cause me more grief.Also now we have to pay an additional $7. a month for a garbage can. Cause we all had turns in taking out the can the night before trash day and it appears we are the only ones that ever does it. So now everyone has a garbage can and we pay for it. It appears to me that the more the landlord did for the people here the more they abused it. I am also looking for a place to move, he has been good to us, but he just rented the apartment across from us to a woman and a man with 4 kids, don't know where they are in the day time, but the kids are wild. How he could put 4 kids in a 2 bedroom apartment I don't know. I couldn't even back out to go to the store today because one was on her bike behind the truck and refused to move. I have already seen and heard the mother and I can tell you that war would of broke out if I had knocked on her door and ask her to move her child. Because of our low income we have brought him so many government programs that has put in insulation and a roof all for free, and now they are talking about updating all his water heaters and heating, I think if I was him I would stop and think before I made a choice in who would stay.

winterose (17874) | 6 months ago | we are in the same situation I on disability, my raise was 10 dollars a month, so a rent increase of 20 or 30 dollars is more than I can afford as well. It is illegal here to put the rent up that high.
it is .03 percent so I was not even going to pay that 30 increase, though I would have accepted 20 dollars only because I could not find another place to stay. I really want to get out of this place it is no good for my health.

but I do need to leave this place for health reasons, my finances are not as bad as they were, but the health reasons are the main reason to need to move at this time.

winterose (17874) | 6 months ago | he doesn't want me to leave, he wants me to stay, and the rent will remain the same, but I do need to leave for health reasons, however I will have the same problem finding a place like I did this time around, I have a small window of opportunity that is between april 1 and june 30 this is one the houses are posted, there is only one official moving day in montreal and that is June 1, leases run from July 1 to June 30 so I am set up until then but if I want to move I have to tell him by april 1 of next year.

winterose (17874) | 6 months ago | I have no choice that is how it works here, I have to follow the law, next year is when I can look for another place and go through the same process as I did this time, I only have between April 1 and June 30th to find a place, this is our law, July 1 is moving day for everyone and people give three months notice if they are leaving and that is for April 1.

45. ladygator (1176) | 6 months ago | I am glad that things are going better for you, but I wonder why does he say he wont do any repairs unless you pay more? That doesnt make much sence. Did you know that you have rights as a tenant? There are certain things that he is posed to do or you dont even have to pay him. You can withhold his rent until your standards are met, if they are major issues.

the repairs he has to do to the building is 25,000 which he says he doesn't have that is why he wants to jack up the rents illegally
he cannot charge 100 a month extra for repairs, and he cannot charge rent increase in advance, he has to do the repairs first and submit the bills to the rental board and then they will only alway him 4 percent
I am very aware of the laws.
my problem was that I really wanted to move and couldn't find a place, but I would have never paid that rent increase and he knew he could not in force it he was just trying to strong arm me,
not one tenant in this building agreed to pay it.

46. Annmac (789) | 6 months ago | I'm glad you've got the situation resolved for this year. Hope you are able to find exactly what you need in the future. The rental system sounds very complicated over there though. I rent from the local town council (UK) and as long as you don't get into arrears or cause problems there's no worries about eviction. Even after my hubby died in April all I had to do was inform them of it and get my name put on the tenancy. My daughter has a private landlord and the rules are pretty much the same for her too. We don't have a set time to move though so finding new places is much easier. I'm just about sorted out with my finances, (what a hassle that's been) and now have a rough idea of what income is coming in monthly. The house is really in need of redecorating (which I've always done thankfully) and I'm hoping the work will help me get through the bad days. It's hard at the moment but I've been through grief often enough to know that I'll come through it and will find happiness again. I just have to stay positive and take each day as it comes for now. Hope you have a really 'peaceful' few months and a good summer to recover from all the stress.

yes I am seeing just by what everyone right that our system sucks, really really sucks, but it does provide protection for tenants so they don't have to be evicted illegally, which I wouldn't have been, or pay illegal rents hikes which I wouldn't have done,

he cannot every few months increase the rent he has agreed not to increase this year but he can in 2010, and if it is too much meaning it is illegal I will not pay it again.

Try to somehow prevent another problem like that one for the next year, so that you don´t get a depression or something. Also, don´t think you are safe, try always to keep some money and not to spend it never...just forget it exists, and when you really, really need it, it will be there.
I had the same problem some time ago, and i really know what you must have felt before he agreed not to increase the fees. It was terrible. But then, a friend offered to help me to endure that moment, and now i am well, some day i will be buying my own estate.

it was not a matter of me not paying the rent, it was the rent hike was ilegal he could not charge 100 dollars extra a month, and no I couldn't afford that I would never have rented a place at that rent because it is not in my budget to do that.
and he was wrong and that is why he relented because he knew it was illegal and he couldn't force his tenants to pay that raise. next year if he does the same thing I will have to fight again or find a new place which is what I really want but I could not find one this year or I would not have been here at all.

And, as you said, it might be a good idea to find another place so that if he goes to far, you can always have a way out. That is the best friendly advice i can give. Good Luck Best Regards

A year goes by very fast, and I would hate to see you in the same bind...That's why I don't rent with a lease. they can kick you out anytime they want, and give you very little time to look for a place. I've been there and done that. Truthfully, there are many landlords that are right up there on the same level as lawyers...it's all about greed, and you get nothing in return.

that is why he didn't enforce it this year because he knew he would lose, he was not doing me any favors he knew he couldn't get away with it.
