I have been in a lawsuit against someone for over 5 years. I think it may be getting close to actually going to trial soon. It has been a long 5 years and I will be so happy to get it done and over with. Have you ever sued someone before? If so, did it take a long time for it to go to trial?

I've always been amazed at the length of time it takes to sue someone. Here in Trinidad the word is that in countries outside Trinidad lawsuits take a relatively short time to conclude. Like about six months or a year. In Trinidad it takes time like yours, five years or more, and the cost is enormous. I'm amazed to hear that in the first world US you have this kind of thing.

Our whole society revolves round whose fault it is ,someone will pay.We don't seem to have accidents anymore.Thats why we are bound by so many health and safety rules at work ect, it is an awful way to live.I would sue if negligence was the cause of what had happened and someone got hurt, but otherwise I would not bother.I hope and pray I never have to consider anything like this.

My son was in a car crash a couple of years ago and the insurance company was being a jerk. I don't normally advise litigation in cases like this but they seem to invite it! We didn't even have to go to trial because once we got an attorney they were eager to settle.
I wish you a good outcome to your suit. It's a shame that people can't behave decently. When I was taking law classes, the vast majority of cases we studied would never have had to go to court (and the defendants would have saved a lot of money) if everyone would have just done the right thing and treated others as they would want to be treated themselves.

Hi, Singlemommy. Unfortunately, I have sued in two civil suits where I had to spend my own money to see justice served. One was a jury trial. I also worked very closely with the attorney doing a lot of the research and reviewing briefs. It was a long hard battle and often I wanted to give up. When we went to trial, I was on the witness stand nearly two full days. Thank God, in the end, justice prevailed and it was all worth it. It did not take 5 years, tho. It took nearly 3. That was still way too long. I wish you the best. Hang in there.

hi singlemom. it's not actually me who filed the complaint but i just helped my sister-in-law. it's almost 2 years now that my SIL caught her husband having an affair with another woman. she actually caught him in their own room. funny about that, the other woman hid herself in their closet. lol
so she filed the complaint with the court, 2 years ago. at this time, the case never been heard. i don't know about it, maybe because her husband already left the country and is now working abroad.
court cases here really take a lot of time and money before it get started and ended. there are a lot of pending cases in the court so we cannot also push the judges hear and decide on every cases.

Although I have wanted to I have never taken anyone to court, in fact I did not even attend for my own divorce! As far as I can remember I have never been inside a court room except the Children’s Court when my sister got into minor trouble as a teenager. I hope your trial goes well and you receive the outcome you want; I know it is usually a stressful, lengthy and expensive exercise! Good luck with it...

i filed a criminal case against a woman in april 2008. a warrant of arrest was issued in october of the same year. the woman was arrested in feb. 2009. it was scheduled for pre-trial conference in june 2009. on october 16, 2009, i executed an affidavit of desistance because all i wanted was to be paid and i was. there was no other way to enforce payment than file a criminal case because the checks she issued to me bounced. some cases take long to be heard because of some reasons. in this case, if the woman was not arrested and the pre-trial conference did not take place, the case would have dragged for long. her presence was important in the pre-trial conference to answer whether she is guilty or not of the charges in the complaint against her.

Hi singlemommy. No I haven't sued anyone in my entire life but I would like to. But I know it's not that easy. It will undergo many processes and I think it's not worth it if I continue my plan. So I just let it go. By the way I'm glad about your progress. Five years is very long. Good luck to you.

No, not personally. However I've know family and friends who sued or who were sued. One of my friends got into an auto accident and sued the people and their insurance company. She won over 11 000 USD from the lawsuit. However, I believe her lawyer charged a lot of fees so I'm sure she only got about 75% of that.
What is your lawsuit about? There are some good websites and forums about laws, lawyers and lawsuits out there on the web, singlemommy. Cheers!
