Should there be any limits on free speech?  |

I was thinking today after reading that one of the radio stations here in my city gave away the home phone to one of the mayoral candidates to listeners. The radio DJ (is that what you call them on AM radio?) announced the phone number 6 times during his program. Now, the candidate has started getting death threats. Since I don't listen to AM radio I didn't hear the actual broadcast but, I was able to get information that the radio guy is a supporter of the opposite political party of the mayoral candidate.
So, do you think that certain freedoms of speech should be limited? Would you feel the exact same way if say Keith Olbermann gave out Sara Palin's home phone number? What are your thoughts?

If this man is actually hurt, or killed, because of what the DJ did then the station will certainly be held accountable for the deed since they created it.

Giving out a phone number does not amount to encouragement of any form of violence. At best someone could try to hold him liable for harrassment they recieve over the phone, but he didn't give out the mayor's home address, or any information that would make the mayor more likely to be physically harmed.

3. Taskr36 (4610) | 4 months ago | There are limitations on free speech. This such as slander, libel, inciting a riot, etc., are all limited. I don't think giving out a person's home phone number is among them, at least not in a criminal legal manner.
First off, are you sure the DJ gave out his home number? Often times commentators will give out office phone numbers for mayors, senators, governors, etc. That is not only appropriate, but a great way of helping people know how they can contact their elected officials. If it was his home number, then I think he went overboard. I don't think any of these people should be harrassed at home when they are off the clock.
That being said, I'm not sure there's any legal recourse for this, especially if their home numbers are listed in the phone book. Any laws on the issue would have to be state laws and it would likely result in, or rely on, precedent i.e. judge made law.
For the sake of providing related precedent I'll direct you to another incident where not only phone numbers, but HOME ADDRESSES were given out. After Prop 8 passed in California a group or individual managed to amass a list of people who had given money to the Prop 8 campaign. According to campaign finance laws or such the information can be obtained through a public records request or something like that. The person then made up a Google map showing the names and home addresses of every person on record for having given money to the pro Prop 8 groups. Now, honestly what I have heard from Ben Konop leads me to believe he is an idiot but, still just because I think he's an idiot doesn't mean that he should be threatened or harrassed in anyway. Just like you said the pro Prop 8 people shouldn't either. I mean if they want to protest at the Church than by all means. I know you all are for small government but, aren't you for protection of rights? His man, and the pro Prop 8, have the right to live without fear of their political beliefs no matter if they are different from mine, your's or anyone else's.

If these people are sick enough to make death threats than they would have done it to the number for his campaign office or workplace without his home number. Every single one of these death threats should be investigated and those responsible should be prosecuted.
There is still nothing that says the DJ promoted death threats so I only say that he made a poor judgment by giving out the guy's personal number instead of the number for his office. Beyond that I'd say people who disagree with his actions should do the same thing they've done to Letterman and Beck, call the sponsors and tell them not to advertise on their programs.

It appears that this all started because Konop would not go on WSPD because he thinks they are to extreme. It's very interesting how conservatives are all about personal responsibility except of course when it's their personal responsibility. Because, the DJ takes no responsibility for giving out the personal cell phone, not the county's cell phone number to his listeners, dumb DJ said, "If Baby Ben Konop is wetting his pants over alleged death threats, he may consider changing his phone number," says Wilson."

DJ's in NYC have gotten fired for doing things less serious than that! I don't think that is appropriate no matter who's side you are on! That is just unacceptable and dangerous, as you have already stated! I think that DJ should lose his job and if he was working here in NY he would probably lose his DJ license! There are just some lines of privacy that shouldn't be crossed like putting someones life in jeopardy!

What if I am inciting a crowd to riot?
What if I am spewing nothing but hate, and encouraging others to go kill certain other people?
Should I be free to do all that?
Unfortunately, there HAVE to be limits.

This right wing hate radio idiot would go crazy if someone published his own personal phone number (I read that someone published this, but it wasn't there when I click on the link). I am sure that no one on here would want another member of MYLOT knowing their home phone number, so I think we should allow our politicans that same courtsey.

The people who called in death threats broke the law. Unless it can be demonstrated that the DJ was an active part in the threats, then he can't be considered part of it.
Yes, it would be the same as if Keith Olbermann gave out Sara Palin's home phone number... still a dirty trick, but it isn't right to blame everyone for the stupid acts of individuals.
Privacy laws for public officials are different than for the rest of us. There are a lot of things that we can say about them and be protected by freedom of speech. On the other hand, you can (for example here) say that you hope a bullet finds my head someday soon. That would be against MyLot TOS, but only illegal if you worded it as a threat... but if someone made the same statement in regards to a public official... well, that's when the guys in the dark suits and no sense of humor show up.

But, the program director at this channel is also like Rush so he allows the DJ's to say whatever they want. I also found out something very funny or atleast odd, the program director tried to lead an effort to recall our mayor (he's out in Jan 2010) I can understand that our mayor is an idiot but, the program director doesn't even live in the city, he lives in another city LOL.
I look at it this way with public officals, if it isn't an emergency they shouldn't be bother by the public at home. I wouldn't allow my boss to call me at home to ask me stupid questions I give that same respect to elected officals even ones I don't like.

Because limits to freedoms always slide right into restrictions, and then, eventually, to eliminations.
I'm not saying that that's not despicable, but seriously...there's stuff the guy whose phone number was abused can do. He could sue the radio host for example. I'm surprised the radio host thought that he WOULDN'T get sued, in fact.
It's not like we're defenseless when someone abused their freedom to speak. There's always something we can do about it. It's just that law doesn't have to come into play.
