I Guess I Shouldn't Have Gone Over to Facebook...

OMG! I don't go on Facebook very often but today I was checking some posts from some silly groups I'm a member of on there. Just leisurely checking out pics of animals and such. Low and behold I come across a video of a friend explaining something that happened to her. Being a curious person I listened in. She got arrested earlier today! No reason was given. Two cops showed up at her apartment, put her in handcuffs and took her to the police station. She was put in a cell and chained to a chair. She used to be a member on Mylot. She lives in NYC and has a small business selling cards and jewelry. She has some psychological issues but does pretty well for herself. I text with her occasionally on Facebook. So eventually she was released. She came home and did the video I was watching. She was scared someone she knew would see her when she was being taken down in the elevator. How mortifying that would have been. She said they never gave her her Miranda rights and never told her what the arrest was concerning. Of course. They never do. But not giving her her rights is not good. Plus, they said they let her go because what she had supposedly done was done in another county and not in their jurisdiction. What a bunch of hooey. Our law enforcement at its finest. How weird.

By law, they have to tell you why they're detaining you and, if they aren't arresting you, they don't have to read you the Miranda rights. You should keep asking why they're detaining you, though. Not asking can be used against you in court. (They can assume you already know why you're being taken to the police station if you don't ask.)

So that's just one other thing she could sue them for. No Miranda rights given, wrong jurisidiction and not letting her know what was going on. Thanks for the info.

@DaddyEvil .......Thank you. No, they told her they were arresting her. Of course they could lie about it later too. How awful about the fire accusal.. Some policemen really enjoy being mean and nasty. When my granddaughter was a teen I called them many times because she would run away. I got many different types. Some were very helpful and nice while others were disgusting and flip about it all.

@celticeagle You're always welcome. Uhm... If they only took her in for questioning, she can't sue them. They have the right to question anybody they want for whatever they want. I had to go in for questioning once years and years ago... Somebody set an apartment on fire here and I was accused of doing it. They didn't arrest me but they were nasty about questioning me. I started answering some of their questions and then one of the cops jumped up and pointed at my hands, which were trembling from hyperthyroidism, and told me the trembling was because I was lying to them and the trembling was from feeling guilty. I laughed at him and told him I had a thyroid disease and my hands trembled all the time. Then asked if they were arresting me because I was ready to go home again. They told me they didn't have enough evidence to arrest me or charge me with the crime. I grinned at them while walking out the door and driving home.

Yes, and she wants to chronical everything for legal reasons which I think is smart. I hope she sues NYPD.

I am sure@DaddyEvil is correct, you have to ask why they are arresting you. Knowing the precise charges is the first building block for your defense.

@DaddyEvil .......She told the story several times in the video and never swayed from the story. She never lied to me and I always have maintained she was a good person. I have known her for about 20 years, and she has been through a lot with her daughter when she was younger. She and I bonded over that. We had that in common. I don't like being lied to either and I never caught her in one.

It sounds smart to me. She was being meek because she is a Black American and probably afraid they'd abuse her in some way.

@celticeagle If the cops really believed she'd done something wrong, even if they weren't within the correct jurisdiction, they could have still held her for the cops from the other jurisdiction to come get her. I think she's lying to you. I know who you're talking about and she lied to us all the time. I stopped talking to her because I didn't/don't like being lied to.

Yes, she should. That was my remark to her. They didn't give her her rights and they were in the wrong jurisdiction and had to let her go.
